Africa-Press – South-Africa. <\/strong><\/span>Earlier this week, regulator the Independent Communications Authority of South Africa (Icasa) published draft regulations for public comment. Included was a proposal to tie South Africans’ biometric data to their SIM cards – and, by extension, their phone numbers.<\/p>\n

This is proposed to crack down on SIM swap fraud and it may well be the only solution to protect the greater society.<\/p>\n

Your cellphone could provide<\/p>\n

a way for cybercriminals to access your financial accounts and gain access to<\/p>\n

your sensitive personal information and other accounts – all of this<\/p>\n

through your mobile number.<\/p>\n

As soon as a criminal is able<\/p>\n

to change the SIM card connected to your mobile number, it gives<\/p>\n

them control over your mobile number \u2014 and they are able<\/p>\n

to receive the access code to your account.<\/p>\n

This gives the criminal free rein to<\/p>\n

act as if it they are you conducting transactions while you are completely unaware of<\/p>\n

what is taking place. In fact, no one will ever know that it was not you that<\/p>\n

withdrew all the money in your current account when it was withdrawn from your<\/p>\n

mobile app.<\/p>\n

SIM card fraud is unfortunately rife in<\/p>\n

South Africa and mobile network operators are at a loss how to deal with this.<\/p>\n

In addition, the RICA legislation (Regulation of Interception of<\/p>\n

Communications and Provision of Communication-related Information Act 70<\/p>\n

of 2002) places a positive obligation on mobile<\/p>\n

network operators to obtain certain when a<\/p>\n

SIM card is sold.<\/p>\n

Before a<\/p>\n

telecommunication service provider enters into a contract with a<\/p>\n

subscriber or sells them a SIM card, the telecommunication must get<\/p>\n

details such as the subscriber’s full names, identity number, residential<\/p>\n

and business or postal address, whichever is applicable; and a certified<\/p>\n

photocopy of their identification document on which their photo, full<\/p>\n

names and identity number, whichever is applicable, appear. Such information<\/p>\n

must also be retained.<\/p>\n

The problem, however, is<\/p>\n

that mobile network operators make use of various entities to sell SIM cards and<\/p>\n

cannot be at all places as all times to monitor that this information is<\/p>\n

correct and in fact obtained. Whether we like it or not, fraud<\/p>\n

takes place, and this means that SIM swaps take place. There is sometimes no<\/p>\n

record of the person behind a SIM card and this allows for<\/p>\n

criminal activity to take place unchecked.<\/p>\n

In a world with various<\/p>\n

pieces of legislation in place, the broader legislative landscape<\/p>\n

should serve the public interest. It is undoubtedly in the<\/p>\n

public interest to prevent or at least aim to limit cyber fraud and therefor<\/p>\n

collecting biometric information could very well serve the public interest.<\/p>\n

Icasa as the<\/p>\n

telecommunication regulator should support mobile network obligations and put<\/p>\n

forward solutions that benefit the industry and society in general. This might<\/p>\n

just be a workable solution. The future will shed light as to the possibilities<\/p>\n

when it comes to SIM card fraud and curbing that through biometric data.<\/p>\n
