{"id":8551,"date":"2021-04-16T18:13:32","date_gmt":"2021-04-16T18:13:32","guid":{"rendered":"https:\/\/www.africa-press.net\/south-africa\/?p=8551"},"modified":"2021-04-16T17:13:45","modified_gmt":"2021-04-16T17:13:45","slug":"burger-giant-and-food-truck-owner-in-a-smash-up-over-trade-name","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/south-africa\/all-news\/burger-giant-and-food-truck-owner-in-a-smash-up-over-trade-name","title":{"rendered":"Burger giant and food truck owner in a smash up over trade name"},"content":{"rendered":"<p><span style=\"color: #ff6600\"><strong><a href=\"https:\/\/www.africa-press.net\/\">Africa-Press<\/a> &#8211; <a href=\"https:\/\/www.africa-press.net\/south-africa\">South-Africa<\/a>. <\/strong><\/span>Cape Town &#8211; Burger giant RocoMamas has been accused of \u201ccorporate bullying tactics\u201d after they threatened legal action against a Mandalay food truck owner if he didn\u2019t change the name of one of his burgers.<\/p>\n<p>Rack n Grill owner Muammer Kasu received a letter dated April 14 from franchise chief executive, Anton Geldenhuys, that RocoMamas was the registered proprietor of the \u201cSmashburger\u201d in South Africa.<\/p>\n<p>They allege Kasu\u2019s \u201cSmash Burger\u201d is an infringement, and gave him 48 hours to change it.<\/p>\n<p>\u201cYour company, trading under the name and style \u2019Rack n Grill\u2019 has been using and continues to use on its trading name, menu, and by way of advertising a product, a mark consisting of the words \u2019Smash Burger\u2019&#8230; We hereby demand that you immediately remove the offending mark from your menu, marketing, advertising materials&#8230;within 48 hours,\u201d Geldenhuys\u2019s letter read.<\/p>\n<p>Speaking to the Cape Times on Thursday, Kasu said he was seeking legal advice, but would change the name in the meantime as he wanted nothing to do with them.<\/p>\n<p>\u201cThey now want me to change the name \u2019Smash Burger\u2019 which is two words, while they have trademarked \u2019Smashburger\u2019 which is one word&#8230;.I can understand that it is similar, but also according to their certificate they cannot use the two words separately. Now they want to bully me into changing it,\u201d he said.<\/p>\n<p>Kasu is a qualified chef who started a food truck in 2015.<\/p>\n<p>He said he could not believe that the \u201cbig corporation was bullying a small single-owned business\u201d.<\/p>\n<p>\u201cI was completely shocked when I received the email, I was completely shocked and I was completely taken away.\u201cI have been getting some great advice from our association, I think we can rather add that I will remove &#8220;Smash Burger&#8221; from our menu as we do not wish to have any similarities to the group of companies in no way whatsoever.\u201d<\/p>\n<p>Kasu said he requested an extension of 14 days to respond to their email and to seek legal advice, and the franchise agreed.<\/p>\n<p>Chairperson of Cape Town Food Truck Association, Hayden Seboa slammed the franchise for \u201cdisgusting corporate bullying tactics\u201c.<\/p>\n<p>\u201cThey have a trademark for \u2019Smashburger\u2019, he calls his \u2019Smash Burger\u2019. The only reason they probably filed a trademark for \u2019Smashburger\u2019 was to prevent a growing USA chain called Smashburger from ever entering the SA market.
