{"id":97068,"date":"2026-04-10T13:17:10","date_gmt":"2026-04-10T13:17:10","guid":{"rendered":"https:\/\/www.africa-press.net\/south-africa\/all-news\/legal-changes-facilitate-skilled-professionals-relocation"},"modified":"2026-04-10T13:23:02","modified_gmt":"2026-04-10T13:23:02","slug":"legal-changes-facilitate-skilled-professionals-relocation","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/south-africa\/all-news\/legal-changes-facilitate-skilled-professionals-relocation","title":{"rendered":"Legal Changes Facilitate Skilled Professionals&#8217; Relocation"},"content":{"rendered":"<p><span style=\"color: #ff6600\"><strong>Africa-Press &#8211; South-Africa. <\/strong><\/span>Proposed immigration reforms will introduce a merit-based, points-driven system that prioritises economic contribution, making it easier for skilled professionals and their spouses to live and work in South Africa.<\/p>\n<p>The Cabinet has officially approved the Revised White Paper on Citizenship, Immigration and Refugee Protection (CIRP).<\/p>\n<p>According to Xpatweb, this marks one of the most complex and consequential governance undertakings in South Africa\u2019s democratic era.<\/p>\n<p>The policy is a significant move towards promoting economic development, enhancing national security, clamping down on fraud and abuse, and improving service delivery through digital transformation.<\/p>\n<p>Importantly, the Cabinet-approved version of the White Paper confirms that the core policy principles contained in the draft version published for public comment in December 2025 remain largely unchanged.<\/p>\n<p>In a statement on 8 April 2026, Home Affairs Minister Dr Leon Schreiber lauded the approval.<\/p>\n<p>\u201cThe approval of the Revised White Paper by Cabinet marks another important milestone on our journey to fundamentally reform South Africa\u2019s civics and immigration systems,\u201d he said.<\/p>\n<p>\u201cThe policy direction outlined in the White Paper charts a new course for our country to build modern, efficient and secure systems that serve South Africa\u2019s interests.\u201d<\/p>\n<p>The Department of Home Affairs (DHA) will now proceed to draft and table the requisite legislative amendments in Parliament to implement the Revised White Paper.<\/p>\n<p>Xpatweb managing director Marisa Jacobs noted that the approved White Paper firmly positions economic contribution at the centre of immigration policy.<\/p>\n<p>Under these reforms, work visas and permanent residence will be assessed on economic merit, and citizenship will prioritise a measurable contribution to South Africa.<\/p>\n<p>The DHA previously explained that citizenship decisions should not be arbitrary but instead reserved for individuals who demonstrate commitment to South Africa\u2019s economic and social development.<\/p>\n<p>Applicants with critical skills, who create jobs, invest in businesses, or contribute to economic growth would score higher under the points-based system.<\/p>\n<p>Jacobs described this as a positive development to boost South Africa\u2019s economic growth and enable businesses to attract the skills needed to build a sustainable and prosperous South Africa.<\/p>\n<p><b>Reform on spousal work rights and retirement visas<\/b><\/p>\n<p>A welcome outcome of the approved White Paper is the easing of restrictions on spouses of skilled visa holders. Previously, excluding spouses from the labour market made South Africa less attractive to global talent.<\/p>\n<p>With these reforms, the policy will now allow spouses of skilled worker visa holders to apply for work authorisation through the points-based system, with some requirements relaxed.<\/p>\n<p>While not granting automatic work rights, this introduces a clearer, more practical pathway to employment. Jacobs said this is a meaningful shift toward improving South Africa\u2019s competitiveness in attracting scarce skills.<\/p>\n<p>Historically, the lack of an easy pathway for spouses to work has disqualified South Africa as a destination when foreign professionals with scarce skills were considering overseas assignments.<\/p>\n<p>\u201cMany accompanying spouses are themselves highly skilled, representing an untapped economic benefit for South Africa,\u201d Jacobs said.<\/p>\n<p>The Revised White Paper also introduces stricter controls on the Retired Person Visa. Previously, there was no minimum age requirement.<\/p>\n<p>As such, the DHA has approved many applicants as young as 25 for this visa. Moving forward, the requirements now include \u2013<\/p>\n<p>A minimum age limit<\/p>\n<p>Higher financial requirements in line with the cost of living in South Africa<\/p>\n<p>Limited exceptions in genuinely justified cases<\/p>\n<p>In addition, the current financially independent residence pathway will shift to an investment-based model, requiring applicants to commit a portion of their wealth to South Africa.<\/p>\n<p>According to the White Paper, these changes aim to ensure that retirement visas are used as intended and not as a workaround for some to later take up employment.<\/p>\n<p>Jacobs explained that the reforms create new opportunities. It opens a pathway for businesses to attract highly skilled professionals eligible for permanent residence through a merit-driven system.<\/p>\n<p>They will no longer have to rely on the current system, which is based primarily on the professional\u2019s length of stay.<\/p>\n<p>Similar frameworks are used in countries such as Canada, Australia, and the United Kingdom, where point thresholds are adjusted to reflect changing economic priorities.<\/p>\n<p>However, Jacobs cautioned that with the new opportunities come new compliance considerations for everyone involved.<\/p>\n<p>\u201cWith the recalibration of South Africa\u2019s immigration system, early engagement and careful planning will become increasingly important for employers, investors, and migrants,\u201d she said.<\/p>\n<p>\u201cEspecially HR leaders, global mobility professionals, multinational employers, and foreign national employees should take note of the policy changes.\u201d<\/p>\n<p><b>Key reforms in the Revised White Paper<\/b><\/p>\n<p>Home Affairs Minister Leon Schreiber<\/p>\n<p>Some of the most notable reforms now approved relate to immigration reforms designed to ensure alignment of the visa system.<\/p>\n<p>This includes the introduction of new visa categories for start-ups and skilled workers, which combine the existing critical skills and general work visas into a single category.<\/p>\n<p>It also includes sports and culture, as well as the replacement of corporate visas with sectoral work visas for specific industries.<\/p>\n<p>Besides the merit-based points-based system for certain visas and permanent residency, it supports the rollout of the Electronic Travel Authorisation to digitise and secure the visa application process.<\/p>\n<p>Other notable changes relate to citizenship.
