AfricaPress-Tanzania:<\/strong> THE executive and the judiciary have agreed to fully switch the country\u2019s legal system and legal materials from English to Kiswahili language, a centenary since the establishment of the High Court in the country.<\/div>\n

Vice-President Ms Samia Suluhu Hassan said yesterday that it was unjust to deny justice to a group of the citizens on the grounds of language barrier.<\/p>\n

Speaking at the opening of this year\u2019s Tanzania Legal Week and 100th anniversary of the High Court, Samia said rural residents are unaware of most of the legal process, thus limiting access to justice in their communities.<\/p>\n

\u201cWe are waiting for the full implementation of this plan… Tanzania is an independent state and therefore, it is unfair for people to be denied justice because of language,\u201d she said.<\/p>\n

Ms Samia, who also launched seven guidelines for the judiciary which include management of evidence, enforcement of court orders and use of court services, demanded the judiciary to enhance access to justice systems.<\/p>\n

She hailed the law interpreter for the transformation they attained during the past 100 years which includes recruiting 20 female judges for its high and referral courts.<\/p>\n

\u201cThere are serious revolutions made in the judicial system. You have established strategic divisions, Land, Commercial, Labour and High Court Corruption and Economic Crimes Division,\u201d she said, while emphasizing that the use of ICT has also helped the judiciary to match up with the digital world.<\/p>\n

Chief Justice Prof Ibrahim Juma said the changes within the judiciary are in line with the Fourth Industrial Revolution that calls for transparency and efficiency in delivering justice.<\/p>\n

He said the government had extended the broadband and is working to enhance its e-government that is pushing the court to adopt a fresh system that will help \u2018wananchi\u2019 to have access to justice.<\/p>\n

Prof Juma acknowledged that the language barrier can obstruct the application of laws in a specific situation.<\/p>\n

\u201cWe have conducted an assessment of the state records to establish what hindered the use of Kiswahili,\u201d he said.<\/p>\n

\u201cOfficial government records show that efforts began when Telford Philip Georges was appointed Chief Justice between 1965 and 1971 to ensure Kiswahili is applied in all stages of the court.\u201d<\/p>\n

He said two committees were formed under the then Minister for Justice and the Minister for Education to write a Kiswahili Law Dictionary among other recommendations.<\/p>\n

\u201cThere are no updates regarding the committee but we believe under the country\u2019s Minister for Legal Affairs and Constitution, we will be able to reach our target,\u201d he said.<\/p>\n

Technically 70 per cent of court proceedings in the country are run in Kiswahili. Chief Justice Prof Juma said only legal materials such as judgments are still being recorded in the English language.<\/p>\n

He was optimistic that a strong push by the government to translate all legislations will ease the transition.<\/p>\n

\u201cThe court use \u2018legalese\u2019 a special language that is used by lawyers, we want to have uniformity in all the proceeding and this is possible with a change in concept documents,\u201d he said.<\/p>\n

China had adopted technology translating all courts proceedings in different languages.<\/p>\n

Prof Juma is optimistic that with the advancement in technology, Tanzania should be able to adapt softwares that can transcribe speeches in different languages and help serve time.<\/p>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"
