Africa-Press<\/a> – Tanzania<\/a>. <\/strong><\/span>THE High Court\u2019s Corruption and Economic Crime Division in Dar es Salaam has jailed Abubakari Kilongo and Alex Memba to 30 years in jail each for trafficking in 17 sacks of marijuana weighing 327.56 kilogrammes.<\/p>\n

Judge Elinaza Luvanda ruled against the two accused persons after the prosecution proved the charges against them.<\/p>\n

He noted that the two accused persons were arrested red-handed in possession of 17 sacks of cannabis sativa, commonly known as bhang or marijuana, loaded in a Toyota Prado vehicle.<\/p>\n

According to him, the evidence tendered was direct and that the chain of custody was properly established by the prosecution, as there was no clue suggesting that at any time the chain of custody in respect of the seized drugs was broken.<\/p>\n

The judge explained that a senior police officer seized the consignment in the vehicle that was being driven by Memba while Kilongo was a passenger at the scene of incident at Mingoi road, Mapinga area in Bagamoyo District.<\/p>\n

The judge pointed out that there was ample evidence implicating the accused persons to have been caught red-handed in control of the car which had loaded the sacks of marijuana.<\/p>\n

\u201cThe denial by the accused persons that they were not arrested in possession of the drugs cannot assist them to distance themselves from the liability. As I have said, the evidence presented by the prosecution is direct and water tight,\u201d he said.<\/p>\n

His findings, the judge said, were supported by the evidence of a soldier who pursued the accused from Picha ya Ndege, Kibaha, where his vehicle was knocked by accused persons’ car, up to the final point where they were ultimately intercepted before being surrounded by people.<\/p>\n

\u201cIn view of that, the accused persons\u2019 defence that they were on the way to Mapinga to look for plot, as I have said, is unrealistic and unbelievable, as they did not mention a specific destination or location where they were heading to nor did they mention their host there,\u201d the judge said.<\/p>\n

Following the finding the judge ordered the 17 sacks of cannabis sativa, which were tendered during the trial as exhibits, to be destroyed<\/p>\n

The judge refrained from making any decision on the car used in transporting the illegal products, as the owner, Mr Ibrahim Ghumbi Kilongo, according to the motor vehicle license, was not heard in the matter.<\/p>\n

He left the matter in the hands of the prosecution, if they so wished, to deal with the same under relevant rules.<\/p>\n

During the mitigation session, the prosecution, led by State Attorney Clara Chawe submitted that they had no previous criminal records of the two convicts. However they asked for severe punishment in accordance with the law looking at the seriousness of the offence.<\/p>\n

On the other hand, Advocate Hosea Chamba, for the two convicts, asked the court to give lenient sentence because his clients were first offenders and were still young, adding that the nation and their parents depend on them.<\/p>\n

According to him, both convicts had children who depended on them.<\/p>\n
