{"id":41623,"date":"2021-11-23T18:06:53","date_gmt":"2021-11-23T18:06:53","guid":{"rendered":"https:\/\/www.africa-press.net\/tanzania\/?p=41623"},"modified":"2021-11-23T14:54:04","modified_gmt":"2021-11-23T14:54:04","slug":"stop-obstructing-execution-of-court-decisions","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/tanzania\/all-news\/stop-obstructing-execution-of-court-decisions","title":{"rendered":"&#8216;Stop obstructing execution of court decisions&#8217;"},"content":{"rendered":"<p><span style=\"color: #ff6600\"><strong>Africa-Press &#8211; Tanzania. <\/strong><\/span>THE Principal Judge, Mr Mustafa Siyani, has appealed to various leaders in the country to stop obstructing the execution of court decisions and refraining from making statements on pending cases.<\/p>\n<p>Mr Siyani made an appeal when he met with Arusha Regional Commissioner (RC), Mr John Mongella, on his one-day official visit to inspect various judicial operational activities in Arusha Zone.<\/p>\n<p>&#8220;For many times some officials, some of whom are members of defence and security committees obstruct the execution of court orders. These incidents have occurred in various parts, so when we get the opportunity to meet you we remind each other and this is the concept of good governance,&#8221; he said.<\/p>\n<p>The Principal Judge also noted the presence of officials who make statements on cases which are pending in court, the practices which sometimes could require some of them to come to court to give evidence on the statement they make.<\/p>\n<p>&#8220;So when you get a chance to meet with District Commissioners it is good to remind them of their responsibility to ensure that court orders are implemented and should refrain from making statements on pending cases. Doing otherwise undermines the concept of good governance,&#8221; he stressed.<\/p>\n<p>He also talked about issues related to ethics committees of which regional commissioners are chairpersons at regional level and district commissioners (DCs) as chairpersons at district level..<\/p>\n<p>Mr Siyani was shocked to read in media outlets some DCs complaining about the conduct of a certain magistrates while they have authority to investigate the persons . He requested the RC to remind them that the committees have to meet even where there are no complaints.<\/p>\n<p>The Principal Judge told the RC also that the construction of Integrated Justice Centers was a new concept in the sense that the buildings involved the presence of all stakeholders in the justice system in one building.<\/p>\n<p>According to him, there are offices that have been set aside for the stakeholders, thus, it was the hope of the Judiciary that they would stay in the allocated offices so that citizens could easily get all the legal services in one building.<\/p>\n<p>&#8220;But in some cases we have found that these stakeholders do not stay in their designated offices. These buildings are designed to provide services other than the ones we are used to, &#8220;he told the Regional Commissioner.<\/p>\n<p>Another area that Mr Siyani emphasized touched on the direction the Judiciary was moving in providing online judicial services by 2025 as a commitment expressed by the Chief Justice of Tanzania, Prof Ibrahim Hamis Juma.<\/p>\n<p>The Principal Judge explained that the Judiciary was committed to reducing and subsequently completely eliminating the use of papers in judicial proceedings.<\/p>\n<p>He said that the matter was not only for the Judiciary but also for all stakeholders and the general public. According to him, it was a journey that all stakeholders should take as the Judiciary may have all the facilities but with the public feeling not comfortable to use them.<\/p>\n<p>&#8220;We are doing a lot to ensure that the services of the Judiciary are improved, but we know we cannot go alone. The Executive is our number one stakeholder, so co-operation between the government and the Judiciary is inevitable,&#8221; the Principal Judge stressed.<\/p>\n<p>On his part, the RC extended his congratulations to the new Principal Judge over his appointment to the post and expressed his hope that he would be able to afford the new opportunity he has been entrusted with, considering that he was capable and would meet the expectations of the authorities.<\/p>\n<p>Above all, Mr Mongella emphasized the need for communication between the leaders of both sides in order to have a broader understanding of various issues, thus stimulating timely delivery of justice to the people.<\/p>\n<p>On the issue of ethics committees, the RC assured the Principal Judge that they would meet to address emerging challenges with a view to improving the performance of magistrates and other judicial officers.<\/p>\n<p>The Regional Commissioner also said that the issue of officials making statements on pending cases was an individual offense because the rules are clear, but he said he will tell them to let the judiciary perform its judicial functions without being interfered with.<\/p>\n<p><strong>For More News And Analysis About <a href=\"https:\/\/www.africa-press.net\/tanzania\">Tanzania<\/a> Follow <a href=\"https:\/\/www.africa-press.net\/\">Africa-Press<\/a><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Africa-Press &#8211; Tanzania.
