Africa-Press – Tchad. <\/strong><\/span>Le Conseil National de Transition (CNT) a vot\u00e9 ce vendredi 24 d\u00e9cembre en faveur d\u2019une \u00ab amnistie g\u00e9n\u00e9rale \u00bb pour les rebelles condamn\u00e9s notamment pour \u00ab trahison\u00ab , a d\u00e9clar\u00e9 \u00e0 l\u2019AFP le porte-parole du gouvernement.<\/p>\n

C\u2019est le ministre de la Communication, porte-parole du gouvernement, qui a annonc\u00e9 l\u2019amnistie g\u00e9n\u00e9rale. \u00ab L\u2019amnistie a \u00e9t\u00e9 une condition pour nos fr\u00e8res qui ont pris les armes, il est normal que le gouvernement acc\u00e8de \u00e0 cette revendication.<\/p>\n

Nous remettons le compteur \u00e0 z\u00e9ro pour ces personnes condamn\u00e9es et nous leur souhaitons de rentrer de fa\u00e7on sereine dans leur pays pour assister au dialogue \u00bb, a d\u00e9clar\u00e9 Abderaman Koulamallah.<\/p>\n

Sont concern\u00e9s \u00ab 39 personnes condamn\u00e9es pour des faits d\u2019atteinte \u00e0 l\u2019int\u00e9grit\u00e9 de l\u2019\u00c9tat et de d\u00e9lits d\u2019opinion \u00bb et \u00ab 257 membres \u00bb des groupes arm\u00e9s, d\u00e9tenus et jug\u00e9s notamment pour \u00ab terrorisme \u00bb apr\u00e8s une offensive de l\u2019Union des Forces de la R\u00e9sistance (UFR) en 2019, qui visait \u00e0 renverser le pr\u00e9sident Idriss D\u00e9by.<\/p>\n

Les deux textes de loi ont \u00e9t\u00e9 adopt\u00e9s, avec 68 voix pour, z\u00e9ro contre et une abstention, par les membres du Conseil National de Transition (CNT), qui fait office de Parlement de transition au Tchad. Amnistie s\u00e9lective ?<\/p>\n

Pour Ma\u00eetre Max LoaIngar, pr\u00e9sident de la Ligue Tchadienne des Droits de l\u2019Homme (LTDH) et coordinateur de la coalition de la soci\u00e9t\u00e9 civile \u00ab Wakit Tama \u00bb, cette liste n\u2019est pas assez inclusive, parlant \u00e0 l\u2019AFP d\u2019\u00ab une amnistie s\u00e9lective, parce que les rebelles se comptent en milliers \u00bb.<\/p>\n

La m\u00eame inqui\u00e9tude est mont\u00e9e d\u2019un cran aussi du c\u00f4t\u00e9 du CNT. Pour le d\u00e9put\u00e9 de transition Mahamat Doki Warou, \u00ab quand il faut pardonner, il faut pardonner tout le monde (\u2026).<\/p>\n

Quand on amnistie, on amnistie d\u2019une mani\u00e8re sinc\u00e8re et pas s\u00e9lective (\u2026). Que chacun pense \u00e0 l\u2019avenir du Tchad, notre pays a besoin de pardon \u00bb, propos recueillis par le journal N\u2019Djam\u00e9nois Alwihda Info.<\/p>\n

Plusieurs autres associations des droits de l\u2019Homme au Tchad ont aussi d\u00e9nonc\u00e9 l\u2019absence sur les deux listes de l\u2019amnistie, des rebelles du Front pour l\u2019Alternance et la Concorde au Tchad (FACT) de Mahamat Mahdi Ali, \u00e0 l\u2019origine des combats au cours desquels le Mar\u00e9chal Idriss D\u00e9by a trouv\u00e9 la mort en avril dernier.<\/p>\n

L\u00e9gitimit\u00e9 du PCMT et du CNT Il faut rappeler que les 93 membres du Conseil National de Transition (CNT) ont \u00e9t\u00e9 d\u00e9sign\u00e9, le 24 septembre dernier, par le Pr\u00e9sident du Conseil Militaire de Transition (PCMT), le G\u00e9n\u00e9ral Mahamat Idriss D\u00e9by dont le pouvoir n\u2019\u00e9mane pas du peuple tchadien.<\/p>\n

\u00ab Les conseillers de la transition \u00bb ou \u00ab d\u00e9put\u00e9s de la transition \u00bb vont, au sein du CNT, \u00ab faire office d\u2019Assembl\u00e9e nationale int\u00e9rimaire le temps que les institutions l\u00e9gales de la R\u00e9publique soient restaur\u00e9es \u00bb, a \u00e9t\u00e9 pr\u00e9cis\u00e9 dans un dossier distribu\u00e9 \u00e0 la presse. Mais selon l\u2019article 113 de la constitution du Tchad du 4 mai 2018, les d\u00e9put\u00e9s doivent \u00eatre \u00e9lus au suffrage universel direct.<\/p>\n

Quelle est donc la l\u00e9gitimit\u00e9 de ces 93 \u00ab d\u00e9put\u00e9s de transition \u00bb d\u00e9sign\u00e9s par le Chef de la junte arriv\u00e9 lui-m\u00eame au pouvoir par un coup d\u2019Etat, et dont aucun d\u2019entre eux n\u2019est issu de partis politiques de l\u2019opposition et de la soci\u00e9t\u00e9 civile ? En droit constitutionnel, la vocation \u00e0 exercer un contre-pouvoir politique doit tirer sa l\u00e9gitimit\u00e9 du suffrage populaire.<\/p>\n
