Africa-Press<\/a> – Togo<\/a>. <\/strong><\/span>La chambre administrative de la Cour supr\u00eame du Togo a rejet\u00e9 lundi 26 avril le recours en annulation de Togo Cellulaire concernant l\u2019amende de 1,5 million d\u2019euros qui lui a \u00e9t\u00e9 inflig\u00e9e par l\u2019Arcep en f\u00e9vrier.<\/p>\n

Le 26 mars, Togo Cellulaire, filiale de Togocom d\u00e9tenue par Axian \u00e0 51 % a saisi la chambre administrative de la Cour supr\u00eame, la plus haute juridiction du pays, en demandant l\u2019annulation de la d\u00e9cision d\u2019amende inflig\u00e9e le 19 f\u00e9vrier par l\u2019Autorit\u00e9 de r\u00e9gulation des communications \u00e9lectroniques et des postes (Arcep) pour diff\u00e9rentiation tarifaire, tout en d\u00e9non\u00e7ant un exc\u00e8s de pouvoir.<\/p>\n

L\u2019amende qui repr\u00e9sentait 1 % du chiffre d\u2019affaires certifi\u00e9 de l\u2019exercice 2019 est assortie d\u2019une astreinte de 20 millions de F CFA (30 000 euros) en cas de non-acquittement dans les 30 jours et de 50 millions de F CFA en cas de poursuite de la pratique incrimin\u00e9e. Mais pour l\u2019op\u00e9rateur public qui est pass\u00e9 sous le giron de Togocom, la d\u00e9cision \u00ab est irr\u00e9guli\u00e8re \u00bb.<\/p>\n

Il pointe l\u2019incomp\u00e9tence de l\u2019Arcep \u00e0 sanctionner une \u00ab pratique anticoncurrentielle \u00bb, rel\u00e8ve l\u2019absence d\u2019une nouvelle mise en demeure avant la sanction, et note que l\u2019amende ne devrait porter que sur la p\u00e9riode o\u00f9 la pratique discriminatoire a \u00e9t\u00e9 constat\u00e9e.<\/p>\n","protected":false},"excerpt":{"rendered":"
