Africa-Press – Uganda. <\/strong> <\/span>The Government of Uganda has confirmed the arrival of eight individuals transferred from the United States under a 2025 bilateral agreement on processing protection requests.<\/b><\/p>\n

In a statement, the Ministry of Foreign Affairs said the individuals, who are neither Ugandan nor American but of African origin, arrived on April 1 following approval by a US immigration judge.<\/p>\n

Their asylum claims will now be processed in Uganda in line with international obligations, including the principle of non-refoulement.<\/p>\n

The development signals Uganda\u2019s expanding role in handling transnational migration cases, a shift that is already drawing scrutiny from legal experts.<\/p>\n

The Uganda Law Society, through its Vice President Anthony Asiimwe, has raised concerns over the transparency of the agreement and the adequacy of legal safeguards for the transferred individuals.<\/p>\n

Asiimwe called on the government to make the details of the bilateral arrangement public and to guarantee due process for those involved.<\/p>\n

He warned that Uganda risks becoming a destination for outsourced asylum processing without sufficient legal and institutional protections.<\/p>\n

The agreement, signed in 2025, allows for certain migrants undergoing immigration proceedings in the United States to have their protection claims processed in Uganda, though full details of its scope and implementation remain unclear.<\/p>\n

Legal observers say the lack of public disclosure raises questions about oversight, accountability, and Uganda\u2019s capacity to manage such cases in line with international standards.<\/p>\n

While the government maintains that the process adheres to global refugee protection frameworks, including non-refoulement\u2014which prohibits returning individuals to countries where they may face harm\u2014critics argue that procedural clarity and access to legal representation are essential.<\/p>\n

The arrival of the eight individuals could mark the beginning of a broader policy shift, with Uganda increasingly positioned within international migration management systems.<\/p>\n

Last year, US immigration authorities attempted to deport a migrant identified in reports as Abrego Garcia to Uganda under a third-country removal arrangement, but the move did not go through after legal and diplomatic obstacles emerged.<\/p>\n

His lawyers challenged the transfer, arguing that sending him to a country with which he had no prior ties raised serious due process and protection concerns, particularly under the principle of non-refoulement.<\/p>\n

At the same time, Ugandan authorities did not finalize acceptance of the case, amid questions over legal responsibility and the terms of such transfers.<\/p>\n

Faced with these hurdles, US officials halted the deportation, leaving the case to continue within the American immigration system rather than proceeding with relocation to Uganda.<\/p>\n

The United States sometimes seeks to deport migrants to third countries rather than their countries of origin when direct return is not legally or practically possible.<\/p>\n

This can happen if courts block deportation due to risks of persecution, torture, or conflict in the home country under protections like non-refoulement, or when the country of origin refuses to accept the individual or lacks diplomatic cooperation with the US.<\/p>\n

In other cases, migrants may be stateless or unable to prove nationality, making repatriation difficult.<\/p>\n

Third-country arrangements are therefore used as a workaround to enforce removal orders, allowing US authorities to transfer individuals to countries willing to receive them while still attempting to comply with international and domestic legal obligations.<\/p>\n
