Africa-Press – Uganda. <\/strong><\/span>The Uganda Law Society (ULS) has formally received a complaint raising significant legal and constitutional concerns over the administration of justice, following a submission by Senior Advocate Dr. Peter Musoke Gukiina.<\/b><\/p>\n

The complaint was delivered to the ULS by Dr. Gukiina, a member of the Radical New Bar (RNB) during the 10th edition of the RNB Live forum held in Kampala.<\/p>\n

The development has attracted attention within legal circles due to the seriousness of the issues raised and their potential implications for the rule of law in Uganda.<\/p>\n

According to the ULS, the complaint highlights a complex and troubling legal situation involving two High Court decisions that appear to conflict over ownership and control of the same parcel of land. The matter raises concerns about judicial consistency, protection of property rights, and public confidence in the courts.<\/p>\n

In a formal letter dated April 15, 2026, addressed to the Principal Judge of the High Court of Uganda, Dr. Gukiina seeks guidance on how to execute two allegedly contradictory judgments.<\/p>\n

These include Civil Suit No. 002 of 2019, in which he sued Sudhir Ruparelia, Erieza Lubojje Kaggwa, Ephraim Ntaganda, Speke Hotel (1996) Limited, and the Commissioner for Land Registration, as well as Civil Appeal No. 010 of 2003, involving Erieza Kaggwa versus Dr. Peter Musoke Gukiina.<\/p>\n

Dr. Gukiina states that in the 2019 suit, he sought declarations affirming his lawful ownership of a kibanja interest measuring approximately 1.287 acres on land located in Busiro Block 443, covering plots 49, 50, 52, 74, 75, and 76 in Kongero, Wakiso District.<\/p>\n

He also sought a declaration that Speke Hotel (1996) Limited is a trespasser on part of the land, findings that certain defendants unlawfully evicted him and transferred proprietary interests, and a determination that the Commissioner for Land Registration failed to maintain accurate records regarding ownership of the disputed property.<\/p>\n

At the core of the complaint are allegations that one High Court decision effectively overturned another decision of a court of equal jurisdiction on the same subject matter, while also ordering compulsory acquisition in favour of a private company that had previously been declared a trespasser. The court is further alleged to have allowed the same entity to retain possession of the land and to have determined, on its own motion, the amount of compensation payable.<\/p>\n

Dr. Gukiina warns that such judicial inconsistencies could set a dangerous precedent. He states that, \u201cThis kind of judicial approach, if left unaddressed, risks legitimising land grabbing, undermining the sanctity of court decisions, and eroding public confidence in the administration of justice.\u201d<\/p>\n

The Uganda Law Society acknowledged receipt of the complaint and confirmed that it has taken note of the issues raised.<\/p>\n

ULS eiterated its commitment to promoting good governance, upholding the rule of law, ensuring the delivery of quality justice, and safeguarding public trust in Uganda\u2019s judicial system. A representative noted that the matters raised are of national importance and require careful scrutiny given their broader implications.<\/p>\n

Dr. Gukiina has requested authoritative guidance from the Principal Judge on how the conflicting judgments can be reconciled and executed, stressing the urgency of resolving the contradictions to prevent further legal uncertainty.<\/p>\n
