It does not protect Uganda\u2019s sovereignty. It destroys the sovereignty\u2014the people\u2019s right to self-determination\u2014and hands all power to the Executive instead,\u201d the statement read.<\/p>\n<p>The Bill, tabled on April 15 by State Minister for Internal Affairs David Muhoozi, is currently under scrutiny by Parliament\u2019s Committee on Defence and Internal Affairs. Government officials have framed it as a safeguard against foreign interference, but it has drawn widespread criticism over its scope, legal clarity, and potential impact on constitutional freedoms.<\/p>\n<p>At the heart of the ULS objection is the claim that the Bill attempts to alter fundamental constitutional principles without adhering to mandatory procedures. The Society cited Article 260(2)(b) of the Constitution, which requires a national referendum for any changes affecting the foundational structure of governance.<\/p>\n<p>\u201cThe Constitution is crystal clear: any law which tries to change the most basic rules of how Uganda is governed must be approved by the people in a national referendum,\u201d the statement read.<\/p>\n<p>According to ULS, the Bill bypasses this requirement while introducing sweeping changes that effectively transfer sovereignty from citizens to the state. The Society argued that such a move renders the proposed law \u201cdead on arrival,\u201d describing it as unconstitutional, null, and void.<\/p>\n<p>Beyond procedural concerns, the ULS raised alarm over the Bill\u2019s substantive provisions, particularly those relating to civil liberties. It warned that the legislation introduces vague and expansive offences, including \u201ceconomic sabotage,\u201d which could criminalise criticism of government policy.<\/p>\n<p>\u201cIt turns ordinary criticism of Government policy into the crime of \u2018economic sabotage\u2019. Its rules are so vague and overbroad that the Government can jail almost anyone it dislikes,\u201d the statement read.<\/p>\n<p>The proposed law establishes a comprehensive regulatory framework targeting individuals and entities deemed to be acting on behalf of foreign interests. It introduces the concept of an \u201cagent of a foreigner,\u201d broadly defined to include anyone directly or indirectly financed, supervised, or influenced by foreign actors.<\/p>\n<p>Notably, the definition of \u201cforeigner\u201d extends beyond non-citizens to include Ugandan citizens living abroad, foreign governments, diplomatic missions, and international organisations. The Bill also applies to digital platforms, meaning online advocacy and civic engagement could fall under its provisions.<\/p>\n<p>Under the proposed framework, individuals<\/p>\n<p>classified as foreign agents would be required to register with a department responsible for peace and security within the Ministry of Internal Affairs.<\/p>\n<p>The registration process involves extensive vetting, including scrutiny of applicants\u2019 identity, financial records, health status, and professional associations.<\/p>\n<p>Financial oversight measures are also significant. Banks and money transfer services would be required to submit monthly reports on transactions involving registered foreign agents.<\/p>\n<p>Additionally, the Bill caps foreign funding at approximately Shs400 million annually unless special approval is granted by the Minister.<\/p>\n<p>Foreign-funded actors would also require Cabinet approval to operate in key sectors such as education, health, water, and infrastructure.<\/p>\n<p>The Bill introduces severe penalties for violations. Individuals found guilty of offences such as economic sabotage could face up to 20 years in prison, while organisations may incur fines of up to Shs4 billion.<\/p>\n<p>Authorities would also have powers to confiscate funds deemed harmful to national interests.<\/p>\n<p>Despite these restrictions, the Bill stops short of imposing an outright ban on foreign funding.<\/p>\n<p>Instead, it establishes a permission-based system allowing both government and private actors to receive funds beyond prescribed limits with ministerial approval.<\/p>\n<p>Certain exemptions are provided for licensed professionals, including doctors and engineers, when operating within their regulated roles.<\/p>\n<p>However, even diplomatic actors are not fully exempt, signalling increased scrutiny of foreign engagements across sectors.<\/p>\n<p>Civil society organisations and legal analysts have raised concerns about the Bill\u2019s breadth and ambiguity, particularly the lack of clear thresholds for offences like economic sabotage.<\/p>\n<p>Economists have also warned that the regulatory burden and funding restrictions could deter investment and disrupt sectors reliant on external support.<\/p>\n<p>The ULS echoed these concerns, warning that the Bill could significantly restrict freedoms of expression, assembly, and association, while also undermining academic inquiry and media independence.<\/p>\n<p>\u201cThis Bill is not against foreigners. It is against you. It is an attack on your power, your voice, and your future,\u201d the statement read.<\/p>\n<p>The Society further called on Ugandans to question their elected representatives about the timing and handling of the Bill, alleging a lack of transparency in its introduction and scrutiny process.<\/p>\n<p>Addressing the international community, the ULS cautioned that passage of the Bill would signal Uganda\u2019s departure from democratic norms and international legal commitments, including obligations under regional and global human rights frameworks.<\/p>\n<p>\u201cIf this Bill passes, Uganda will have walked out of the family of democracies.
