According to President Biden, the expulsion of four African countries from the AGOA including Gabon, Niger, Uganda, and the Central African Republic (CAR) is due to their records on human rights and the rule of law. The U.S. decision is effectively ending Uganda\u2019s ability to export certain commodities to the US duty-free.<\/b><br \/>\n<b>The U.S. statements<\/b><\/p>\n<p>In a decree dated December 29, 2023, President Biden announced the termination of the four countries saying they did not meet the requirements necessary to allow them to continue benefiting from the trade deal. The sad news was confirmed by the office of trade representative. The U.S. government determined that the Central African Republic (CAR), Gabon, Niger, and Uganda do not meet the requirements described in section 506A(a) (1) of the Trade Act. \u201cAccordingly, I have decided to terminate the designations of the Central African Republic, Gabon, Niger, and Uganda as beneficiary sub-Saharan African countries for purposes of section 506A of the Trade Act, effective January 1, 2024,\u201d read the statement by the US President.<\/p>\n<p><b>Eviction reasons<\/b><\/p>\n<p>In October last year, President Biden announced that his administration was in preparations to expel the four African countries from the AGOA trade program due to their records on human rights and the rule of law. According to the letter Biden wrote to the Speaker of the House of Representatives, the four countries did not meet the eligibility requirements of section 104 of the AGOA. In the letter, Biden also outlined that the governments of the CAR and Uganda had engaged in \u201cgross violations of internationally recognized human rights\u201d. He also cited Niger and the government of Gabon\u2019s failure to establish or make continual progress toward the protection of political pluralism and the rule of law. The U.S. President condemned Uganda\u2019s recent Anti-Homosexuality Act, calling it a \u201ctragic violation of universal human rights\u201d and stating that he would \u201cincorporate the impacts of the law into U.S. review of Uganda\u2019s eligibility for the African Growth and Opportunity Act. In May 2023 the president of Uganda Yoweri Kaguta Museveni ascended the anti-homosexual bill. The law among others criminalizes same-sex marriages which resulted in Western nations including the World Bank cutting off Aid.<\/p>\n<p><b>AGOA<\/b><\/p>\n<p>AGOA is a U.S. trade preference program that was enacted by the U.S. Congress on 18 May 2000.The program offers eligible countries duty-free access to a U.S. market for over 6000 products from beneficiary countries to the U.S. market.<\/p>\n<p><b>Strings attached to AGOA<\/b><br \/>\n<img loading=\"lazy\" decoding=\"async\" width=\"1280\" height=\"720\" class=\"alignnone wp-image-64190 size-full\" src=\"https:\/\/static.africa-press.net\/uganda\/sites\/34\/2024\/01\/sm_1704471700.378873.jpg\" srcset=\"https:\/\/static.africa-press.net\/uganda\/sites\/34\/2024\/01\/sm_1704471700.378873.jpg 1280w, https:\/\/static.africa-press.net\/uganda\/sites\/34\/2024\/01\/sm_1704471700.378873-300x169.jpg 300w, https:\/\/static.africa-press.net\/uganda\/sites\/34\/2024\/01\/sm_1704471700.378873-1024x576.jpg 1024w, https:\/\/static.africa-press.net\/uganda\/sites\/34\/2024\/01\/sm_1704471700.378873-768x432.jpg 768w\" sizes=\"auto, (max-width: 1280px) 100vw, 1280px\" \/><\/p>\n<p>There are stringent eligibility criteria, outlined in section 104 of the Act, including the requirement that countries establish or make progress towards establishing the rule of law, political pluralism, and the rights to due process, a fair trial, and equal protection under the law.<\/p>\n<p><b>Trying in vain<\/b><\/p>\n<p>Towards the end of last year, President Museveni dispatched his son-in-law and trade adviser Odrek Rwabwogo to Washington, DC on an emergency mission to try to rescue the country from being expelled from the AGOA duty-free scheme as the landlocked country scrambles to contain the fallout from its anti-gay law. The Uganda trade delegation met with the U.S. Assistant Trade Representative for Africa, Ms. Constance Hamilton, and the U.S. special envoy to advance the Human rights of the LGBTQI+ people, Jessica Stern in Washington DC. Rwabogo pleaded that Uganda has not violated any trade or human rights law. Adding that the country under President Museveni\u2019s administration continues to score on economic liberalism, supporting free enterprise, protecting the environment, making laws on food safety, and building the best trade standards. He advised the U.S. government not to mix wrong perceptions picked from data sources that aren\u2019t verifiable with the country\u2019s systems and leaders and use them to make harsh judgments on Uganda. Rwabwogo explained the context of the anti-gay law as an effort to protect children from the onslaught of curriculum and content that should not be exposed to minors.<\/p>\n<p><b>AGOA\u2019s benefits to Uganda<\/b><br \/>\n<img loading=\"lazy\" decoding=\"async\" width=\"1046\" height=\"708\" class=\"alignnone wp-image-64191 size-full\" src=\"https:\/\/static.africa-press.net\/uganda\/sites\/34\/2024\/01\/sm_1704471717.84351.jpg\" srcset=\"https:\/\/static.africa-press.net\/uganda\/sites\/34\/2024\/01\/sm_1704471717.84351.jpg 1046w, https:\/\/static.africa-press.net\/uganda\/sites\/34\/2024\/01\/sm_1704471717.84351-300x203.jpg 300w, https:\/\/static.africa-press.net\/uganda\/sites\/34\/2024\/01\/sm_1704471717.84351-1024x693.jpg 1024w, https:\/\/static.africa-press.net\/uganda\/sites\/34\/2024\/01\/sm_1704471717.84351-768x520.jpg 768w\" sizes=\"auto, (max-width: 1046px) 100vw, 1046px\" \/><\/p>\n<p>In the 12 months to June 2023, Uganda\u2019s exports to the U.S. under AGPA amounted to USD 8.2 million, about 11.5 percent of its total exports to the U.S. in the same period, which totalled USD 70.7 million, data from the U.S. Department of Commerce shows. Uganda exported goods worth USD 174 million in 2012 and USD 82 million in 2021. Over 80 percent of Uganda\u2019s exports under Agoa were from the agricultural sector, which employs about 72 percent of the country\u2019s workforce, indicating that the expulsion could have a significant hit on jobs.<\/p>\n<p><b>Uganda\u2019s response to eviction<\/b><\/p>\n<p>Uganda\u2019s Minister of State for Industry David Bahati, responded resolutely to the U.S. decision to disengage AGOA market by saying that the country will not sacrifice its culture and values on the altar of homosexuality. He emphasized that Uganda\u2019s stance on homosexuality was rooted in the Defense of traditional family structures, aligning with biblical and cultural beliefs that marriage is exclusively between a man and a woman. He expressed confidence in alternative markets, emphasizing the need to enhance product standards to cater to Europe, Asia, and the African market.
