Africa-Press – Zambia. The Daily Nation reports that Patriots for Economic Progress (PEP) has petitioned the High Court over Kabwata seat by election results for possible nullification over alleged violence and other mapracices.
Election petitioning is a constitution and legal demand and right awarded to any aggrieved eligible person(s) to do do It is my hope that the petitioner has the loci standi to petition as per requirement of the law.
Under Section 98 of Electoral Process Act (EPA) No 35 of 2016, the law guides thus thst an election petition may be presented to the High Court by one or more of the following persons
a) a person who lawfully voted or had a right to at the election to which the election petitions relates; b) a person claiming to have had a right to be nominated as a candidate or elected at the election to which the election petitions related
c) a person claiming to have been a candidate at the election to which the election petitions related d) the Attorney General. Outside the above cited persons petitioning the High Court, the petition is brought in dead (BID)
