Africa-Press – Zambia. <\/strong><\/span>FORMER Kabulonga Ward 16 councilor Patrick Mwansa has sued the Anti-Corruption Commission (ACC) in the Lusaka High Court for placing his property in Kafue district under its control. He said the property was not acquired through corrupt practices whatsoever.<\/p>\n

Mwansa wants the High Court to cancel the restriction notice in relation to Stand No. Kafue\/LN_59832\/7 held on certificate title no. CT_50713 and property no. \/4142\/G\/14\/P on title no. CT_51100.<\/p>\n

In an affidavit in support of originating summons, Mwansa who is the husband of Chawama PF member of parliament Tasila Lungu stated that on March 27, 2022 he was served with a restriction notice issued under Section 60 (1) of the Anti-Corruption Act signed under the hand of acting director general Silumesi Muchula.<\/p>\n

He said the notice indicated that the Commission was investigating the alleged corrupt offences suspected to have been committed by him. \u201cThe said notice directed that I should not dispose of or otherwise deal with property number Kafue\/LN 59832\/7 held on certificate of title number CT_50713 and property number F\/4142\/G14\/P held on certificate of title number CT_51100,\u201d Mwansa said.<\/p>\n

\u201cI have an interest in respect of the property that the said notice directed that I should not dispose of or otherwise deal with the property. The said properties, subject of the restriction notice by the Commission, are subject of a third-tarty mortgage with Suleman Ismail Pandor.\u201d<\/p>\n

He said he had limited control of the property upon obtaining a loan facility from the lender, and the interest he holds is subject to the restrictions of the lender.<\/p>\n

Mwansa charged that the issuance of the restriction notice by the ACC was done erroneously for reasons that the person who issued the notice had no authority.<\/p>\n

He said the resignation of the former director general Zacharia Kapetwa Phiri and the expiration of Rosemary Khuzwayo\u2019s contract created a vacancy and did not warrant the appointment of an acting director general (Muchula) who restricted his property. Mwansa said owing to the nullity of Muchula\u2019s appointment the restriction notice was null and void.<\/p>\n
