Former Warriors striker, Shingi Kaondera is suing his former wife, Mary Chiwenga, for irregular divorce after she used forged documents to terminate their marriage.<\/p>\n
Mary, a former model, divorced the former Darryn Tornadoes striker and married Vice President Constantino Chiwenga.<\/p>\n
Kaoendera is demanding US$700,000 from Mary, accusing her of \u201cgrabbing\u201d all their matrimonial property and impoverishing him.<\/p>\n
Through his lawyers, Kashangura Law Chambers revealed that his marriage to Mary was dissolved by a decree of divorce granted by the High Court on May 19, 2011.<\/p>\n
Kaondera filed papers filed on July 15, arguing that Mary never served him with the summons as required by the rules of court. His lawyers said:<\/p>\n
Plaintiff (Kaondera) was not in the country but was in Cyprus where he was a professional footballer at the relevant time.<\/p>\n
Mary fraudulently caused a return of service to be issued by the deputy sheriff at Harare, falsely claiming that plaintiff had been personally served with the summons on June 22, 2010, at Harare.<\/p>\n
Further to that, the defendant (Mary) also fraudulently issued with the honourable court a consent paper dated July 7, 2010, wherein the plaintiff\u2019s signature was forged. Plaintiff never entered into a consent paper with the defendant regarding the divorce proceedings under HC 3805\/10.<\/p>\n
\u2026 As a result of the irregular and fraudulent obtaining of a divorce order by the defendant, the plaintiff was seriously prejudiced in that the defendant remained with all the immovable and movable properties that the parties had acquired during the subsistence of the marriage.<\/p>\n
\u2026 As a direct result of the defendant\u2019s fraud, plaintiff has been impoverished as the defendant unjustly grabbed all the matrimonial assets that the parties had acquired together contrary to the laws of Zimbabwe.<\/p>\n
Wherefore plaintiff prays for an order that the defendant is ordered to pay damages to the plaintiff in the sum of US$700,000 as well as plaintiff\u2019s costs of suit on a higher scale.<\/p>\n
