{"id":2017,"date":"2019-01-18T15:14:37","date_gmt":"2019-01-18T15:14:37","guid":{"rendered":"https:\/\/www.africa-press.com\/zimbabwe\/?p=2017"},"modified":"2019-01-18T15:14:37","modified_gmt":"2019-01-18T15:14:37","slug":"evan-mawarire-charged-with-treason-back-in-court-friday","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/zimbabwe\/all-news\/evan-mawarire-charged-with-treason-back-in-court-friday","title":{"rendered":"Evan Mawarire charged with treason, back in court Friday"},"content":{"rendered":"<div class=\"2ikGLSaq\">\n<div class=\"in-post-div\">\n<p>FIREBRAND rights activist and cleric, Pastor Evan Mawarire appeared before a Harare magistrate Thursday charged with treason and was remanded in custody to Friday as lawyers put up a fight to have his charges thrown out for lack of merit.<\/p>\n<p>Mawarire was seized by armed police from his Harare home Wednesday to face charges of subverting a constitutionally elected government or alternatively, inciting public violence.<\/p>\n<p>This follows a video of himself he posted on social media calling on locals to stay away from their work places in protest over government\u2019s decision to more than double prices of fuel.<\/p>\n<p>Through his lawyer, Beatrice Mtetwa, Mawarire challenged placement on remand saying he was improperly before the court as his alleged conduct did not constitute a crime.<\/p>\n<div class=\"wVM3qMc7\">\n<div class=\"in-post-div\">\n<p>\u201cIf a man of God says \u2018stay at home for the next three days and don\u2019t be violent\u2019, how does that constitute a crime?\u201d said Mtetwa in her submissions before magistrate Lucy Mungwari.<\/p>\n<p>\u201cThe doctors have also been saying \u2018we want US currency\u2019, the teachers, everybody including business have been saying address economic challenges. Is that a crime?\u201d<\/p>\n<p>Mtetwa said if the courts were to find Mawarire\u2019s conduct meriting a criminal charge and trial, then everyone in Zimbabwe must be arrested on similar allegations.<\/p>\n<p>She also requested the state to play the government critic\u2019s video in court to allow the presiding magistrate to determine if what Mawarire said constituted a crime at all.<\/p>\n<p>Appearing for the State, Mirirai Shumba successfully sought for a postponement in order to find time to scrutinise the video before being able to respond to Mawarire\u2019s application.<\/p>\n<p>The case was postponed to this Friday for continuation.<\/p>\n<p>According to the state, on January 14, 2019, Mawarire, acting in connivance with the Zimbabwe Congress of Trade Unions (ZCTU) president Peter Mutasa, recorded and published a video calling on Zimbabweans to boycott work while also encouraging civil disobedience.<\/p>\n<p>The video went viral on social media platforms which include Facebook, Twitter and YouTube.<\/p>\n<p>The State claims the contents of the video were meant to subvert a constitutional government.<\/p>\n<p>During his arrest, Mawarire\u2019s gadgets he allegedly used to record the video were confiscated.<\/p>\n<\/div>\n<\/div>\n<div class=\"in-post-div\"><\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>FIREBRAND rights activist and cleric, Pastor Evan Mawarire appeared before a Harare magistrate Thursday charged with treason and was remanded in custody to Friday as lawyers put up a fight to have his charges thrown out for lack of merit.
