{"id":40688,"date":"2021-05-21T19:19:34","date_gmt":"2021-05-21T17:19:34","guid":{"rendered":"https:\/\/www.africa-press.net\/zimbabwe\/?p=40688"},"modified":"2021-05-21T18:07:52","modified_gmt":"2021-05-21T16:07:52","slug":"no-constitutional-crisis-says-govt","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/zimbabwe\/all-news\/no-constitutional-crisis-says-govt","title":{"rendered":"No Constitutional Crisis, Says Govt"},"content":{"rendered":"<p><span style=\"color: #ff6600\"><strong><a href=\"https:\/\/www.africa-press.net\/\">Africa-Press<\/a> &#8211; <a href=\"https:\/\/www.africa-press.net\/zimbabwe\">Zimbabwe<\/a>. <\/strong><\/span>The government has denied that there is a constitutional crisis after the High Court nullified President Emmerson Mnangagwa\u2019s extension of former Chief Justice Luke Malaba\u2019s tenure by another five years.<\/p>\n<p>High Court judges Justices Happias Zhou, Edith Mushore and Jester Charewa on Saturday granted an urgent application stopping Malaba from benefiting from the changes to the Constitution.<\/p>\n<p>Speaking after the swearing-in of five judges of the Constitutional Court on Thursday, Justice, Legal and Parliamentary Affairs Secretary Virginia Mabiza asserted that there was no constitutional crisis. Said Mabiza:<\/p>\n<p>What we see is not a constitutional crisis. Parties have brought their cases before the court and it is entirely up to the court, the institution to which matters have been brought, to make a decision on whether or not to preside. So there is no constitutional crisis at all. As you can see that the courts are functional.<\/p>\n<p>Justices Paddington Garwe, Rita Makarau, Anne-Mary Gowora, Ben Hlatshwayo and Bharat Patel took their oaths of office before Acting Chief Justice Elizabeth Gwaunza at a ceremony held at the Constitutional Court.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Africa-Press &#8211; Zimbabwe.
