Africa-Press – Zimbabwe. <\/strong><\/span>By Clayton Shereni<\/b> – LAWYERS representing President Emmerson Mnangagwa in the case in which his legitimacy and ascendancy to power is being challenged have written to his representatives demanding he withdraws the case.<\/p>\n

In a notice dated November 11, Mnangagwa\u2019s lawyers by of Dube, Manikai and Hwacha Legal Practitioners accuse Sybeth Musengezi of political grandstanding and seeking relevance by abusing the law.<\/p>\n

\u201cThe respectful stance taken by our clients (which we agree with) is that your client has no case, and the present application is devoid of merit, has been brought for ulterior motives and illicit purposes, including seeking the glory of publicity and for political purpose\u201d the lawyers wrote.<\/p>\n

The lawyers who are representing Mnangagwa and five others in the case went on to give the complainant a seven-day ultimatum to unconditionally withdraw the case.<\/p>\n

\u201cIt is therefore advisable for your client to withdraw his application unconditionally at this stage, tendering wasted costs, to avoid further abuse of process and privilege and forcing the respondents to incur additional costs defending the spurious and vexatious matter,\u201d the letter reads.<\/p>\n

\u201cThis proposal is open for acceptance by your client and yourselves within seven days of the date of this letter, after which it should be treated as having been withdrawn and of no force and effect, unless extended prior to the expiry,\u201d they further wrote.<\/p>\n

Speaking to NewZimbabwe.Com, complainant\u2019s lawyer Alec Muchadehama confirmed receiving the letter but said they are yet to respond to it.<\/p>\n

\u201cThe letter is authentic. They wrote the letter and we received it but we are yet to respond to what they wrote in the letter,\u201d he said.<\/p>\n

Musengezi is challenging the process that led to Mnangagwa\u2019s rise to the helm of the party and country.<\/p>\n

Prior to the current development, Zanu PF and Mnangagwa\u2019s lawyers argued that Mnangagwa was immune to prosecution since he is a seating president and that Musengezi took long to bring his case before the courts.<\/p>\n
