Africa-Press – Angola. Counselor judge Domingas Alexandre Garcia temporarily assumes, for a period of 60 days, the presidency of the Court of Auditors, following the resignation of Exalgina Gambôa.

The information was provided this Monday to press in Luanda, by the spokesman for the Superior Council of the Judiciary, Correia Fernandes Bartolomeu, at the end of a plenary session of this body that considered, among other topics, the decision of the Court of Auditors on the resignation of judge Exalgina Gambôa and the entry into force of the guarantee judges.

According to the spokesperson, in a session led by the president of this body, Joel Leonardo, the plenary of the Superior Council of the Judiciary Magistracy, after consideration, considered the resignation request presented by Exalgina Gamboâ, who ceased her duties as president of the Court of Auditors, to be accepted and an advisory judge.

Correia Bartolomeu said that the appointment of Domingas Alexandre Garcia, then vice-president of the Court of Auditors, to temporarily exercise the functions of president, results from legal imperatives, enshrined in the Organic Law of the said court, to safeguard its normal functioning.

He stressed that the Superior Council of the Judiciary should promote the competition for filling the vacancy which, according to the Law, must be carried out within 60 days after the beginning of the vacancy.

He ruled out the existence of an institutional crisis in the country due to the resignation of the president of the Court of Auditors.

The spokesman for the Superior Council for the Judiciary, Correia Bartolomeu, also informed that the guarantee judges, responsible for supervising citizens’ fundamental guarantees, will start their duties in Angola from the 2nd of May.

These judges will follow the preparatory and contradictory instruction phases, in order to safeguard the fundamental rights of those involved in the proceedings.

“For many years, those who exercised this role were the Public Prosecutor’s Office, the prosecutors, but the Constitution of the Republic imposes that the inspection of the guarantee of fundamental rights must be ensured by judicial magistrates”, he said.

He added that the Public Prosecutor’s Office, until then, has been making decisions and ordering house arrests, preventive arrests, exit bans and searches, but that, with the entry into operation, these competences pass to the guarantee judges.

He also noted that more than two hundred judicial magistrates will be appointed to exercise the functions of guarantee judges, in the 30 districts in operation in the 18 provinces of the country.
