New Law Guarantees the Full Realization of Human Rights

Africa-Press – Angola. The new Law on National Security, in force since 10 September, will contribute to national development, ensure the full realization of Human Rights, and maintain international peace and security.

The diploma, already published in the Official Gazette, also defines as fundamental objectives national independence and sovereignty, defence and territorial integrity, guarantee of the Democratic State and the Rule of Law, respect for fundamental rights, security of the population and their assets, and the defence and protection of institutions and national heritage.

According to the foundations of the diploma, the current reality shows that the challenges to national security are transversal and require greater inclusion, citizen participation, as well as better articulation and coordination of sectors and institutions, in order to guarantee stability and sustainable economic and social development.

With regard to principles, the decree states that the National Security System is based on human dignity, legality, priority, rationality, control and supervision, proportionality, loyalty, subordination and hierarchy.

The diploma also highlights, among the principles to be preserved, State secrecy, professional secrecy, non-partisanship and cooperation, which consists of strengthening relations between regional, continental and international sectors and the National Security System, in the interest of national security.

National security, according to the same Law, has the fundamental objective of permanently guaranteeing national independence and sovereignty, territorial defense and integrity, the Democratic State and the Rule of Law, respect for fundamental rights and the security of people and their property.

It also represents a purpose of National Security, as stated in the diploma, the maintenance of peace and public order, under conditions that correspond to the national interest and international stability, as well as the protection of the environment, biosafety, and the promotion of sustainable economic and social development, including cyberspace.

Competence of the President of the Republic

Regarding the powers of the President of the Republic, the diploma states that he is the body responsible for directing national security policy and strategy, responsible for defining and directing its implementation, determining, guiding and deciding on the strategy of action.

The President of the Republic is also responsible for approving the operational planning of the system and deciding on the strategy for the employment and use of the Angolan Armed Forces (FAA), the National Police and the Intelligence and State Security Bodies, among other tasks set out in the diploma.

With regard to the National Security Council, the diploma clarifies that it is the advisory body of the President of the Republic on matters relating to the conduct of the National Security policy and strategy, as well as the organization, functioning and discipline of the FAA and other bodies guaranteeing constitutional order and the State Intelligence and Security Bodies, in particular.

The National Security Policy also consists of a set of principles, guidelines and coordinated measures aimed at pursuing the country’s security objectives, in accordance with the current reality of continental and international geopolitics.

Rules for exporting Quartz mineral to industry

The President of the Republic approved the decree on the Rules and Procedures Necessary for the Supply of Quartz Mineral to the Industry for Processing and Transformation, Laboratory Analysis and Issuance of Export Guides.

The diploma, published in the Official Gazette on 10 September, is justified by the need to establish procedures for the export of metallic silicon or metallurgical grade silicon and polycrystalline silicon or polysilicon, for laboratory analysis.

The President of the Republic, in accordance with the Constitution, instructed the Ministries of Finance, Industry and Commerce and Mineral Resources, Oil and Gas to approve the rules and legal procedures.

According to the new standards, it is considered that in the case of the mineral Quartz, its natural form must have a chemical compound of silicon dioxide, while metallic or metallurgical grade silicon has a purity level of 98 to 99.8 percent.

The Presidential Decree also clarifies that polycrystalline silicon or polysilicon, the form of silicon, must have a purity of over 99.9 percent in its composition, produced through several stages of the process of obtaining the chemical substance.

The minerals in question and their licenses, as stated in the same decree, must be issued upon presentation of the declaration attesting to the degree of purity of the mineral, as well as other documents required by the Ministry of Industry and Commerce in the export process.

The certificate, which must attest to the degree of purity of the substance, the diploma also states, must be issued by the Geological Institute of Angola (IGEO), based on samples extracted from the batch to be exported, collected by this institution or sent by the interested party, under the terms of the respective instructions.
