Africa-Press – Botswana. Extension II Chief Magistrate Kamogelo Mmesi has questioned why the prosecution is continuing with the threat to kill and assault case against former Botswana National Sport Council (BNSC) CEO, Tuelo Serufho, instead of withdrawing it with liberty to reinstate.
The former BNSC CEO is charged with assault and threat to kill against Mpho Pule, believed to be a friend of his wife. He is alleged to have physically attacked Pule and threatened to end her life at Gaborone Golf Club back in July for trying to ruin his marriage.
Appearing before the court today, the state indicated that the investigations into the Serufho case are still at an infant stage. “The accused (Serufho) is out on bail and the investigations in the matter are not yet complete as the Investigating Officer (IO) is yet to record some witness statements,” state prosecutor Modisaotsile Seratswe said.
With the state raising that the investigations are lagging, Magistrate Mmesi questioned why the matter is before the court if the state is not ready to proceed. “You were not supposed to arrest him with the investigations not yet complete. Why not withdraw it and reinstate it later?” asked the magistrate.
Hell bent against the notion, Seratswe pleaded with the Magistrate to give them a grace period and get their house in order while they wrap up their investigations. “The only evidence we have now, we had hoped that the IO would have wrapped it up by now. So we are hoping for an indulgence to wrap up the case,” Seratswe pointed out.
Even though magistrate Mmesi had questions about why the matter is continuing, she leaned towards the state but gave them an ultimatum. “The case is set for status update on December 8, and the prosecution is advised that if they are not able to finish their investigations by then, they should withdraw the case with liberty to reinstate,” she ordered. The case continues.
