Africa-Press – Cape verde. The Lisbon Court declared null and void the attachment of TACV airport slots “Slots” at Lisbon airport and determined the immediate cancellation of the electronic auction for the purposes of selling these airport slots.

This court decision is in line with the arguments invoked by NAV Portugal – Navegação Aérea, which appealed to the courts to protest against the seizure of TACV’s slots.

This, due to an alleged accumulated debt, protest also corroborated by the Cape Verdean airline that considered the attachment “illegal”.

This sentence prevents these slots from being sold in an electronic auction.

NAV clarification

NAV, the entity responsible for air traffic management, then clarified that “national and community legislation does not allow the seizure or auction of airport slots and fought for the nullity of the execution before the judge of the case”.

The arguments presented, according to Jornal Negócios, were handed over to the Lisbon Execution Court – Judge 8 of the Judicial Court of the District of Lisbon, who determined “by summary decision, dated June 29, 2023, that the asset cannot be seized and the pledge of slots is null.

Court orders immediate cancellation

The court also indicated that the enforcement agent must immediately cancel the electronic auction for the purpose of selling these ‘slots’”.

The electronic auction had started on the 19th of June and ended on Wednesday of the following week, the 12th of July. In addition to NAV, TACV also considered the attachment “illegal”.
