Africa-Press – Cape verde. José Maria Neves announced this Tuesday the promulgation of the law that creates the Justice Information System (SIJ), after requesting supervision from the Constitutional Court, which did not place obstacles to its entry into force.

The President of the Republic understood that the law could “undermine the principle of separation of powers” ​​by assigning “the strategic and operational administration of the SIJ to a public institute that will operate under the supervision of the member of the Government responsible for the area of ​​justice”, he said. in a statement.

However, the Constitutional Court decided “not to rule on the unconstitutionality” of the attribution “of technological and operational management of the system to a public institute” under the jurisdiction of justice, he added, in the document released by the Presidency of the Republic.

According to the statement, the law was enacted on Saturday.

The Cape Verdean Minister of Justice, Joana Rosa, said in December, in parliament, during the approval of the law that created the SIJ, that the system will be managed by an institute, but the administration of the processes will continue to be the responsibility of the courts – this after the Superior Council of Judiciary (CSMJ) of Cape Verde had claimed this management for itself.

“Judges are not prepared to monitor an information system”, he explained, explaining that it should be managed by an institution similar to the one that accompanies the Citius electronic portal for Portuguese justice.

The platform was developed by the University of Aveiro, in Portugal, under the coordination of the Cape Verdean Ministry of Justice, which decided to create its own system from scratch.
