Incarcerated pro-democracy MPs’ lawyer writes to High Court Registrar, demands bail hearing date

Africa-Press – Eswatini. Ben J. Simelane, the lawyer representing pro-democracy Members of Parliament(MPs) has written a letter to the Acting Registrar of the High Court Nosipho Mazibuko demanding a date for a bail hearing.

“The matter has not been set-down yet since the High Court has been in recess from the 19th August to the 12th September 2022. The Respondents had initially filed Notice to Raise Points of Law on the 1st September 2022, but has since answered on the merits. With the outmost of respect kindly enquire from Her Ladyship M. Dlamini J the requisite timelines for the parties to file their respective heads of arguments, thereafter when it would be suitable for the matter to be heard and liaise with us thereto ” reads a letter from lawyer.

Reached for comments, Ben J. Simelane, the lawyer representing the pro-democracy MPs confirmed writing a letter to the Registrar of the High Court.

“It’s true that we wrote to the Registrar requesting a date for the bail hearing. We are now feeling frustrated because, a bail by its nature, is urgent. We first called the Registrar and after realizing that there are some problems, we decided to formalize the enquiry by writing the letter requesting her to enquire the date from the Judge,” said the lawyer.

Efforts to reach the Acting High Court Registrar proved unsuccessful at the time of compiling this report.

MPs Bacede Mabuza and Mthandeni Dube were arrested by the police after an order allegedly issued by King Mswati, the MPs were leading the calls for democratic reforms in Parliament.
