Africa-Press – Eswatini. Minister of Finance Neal Rijkenberg has tabled the Income Tax (Compliance Certificates) Regulations of 2022.
The regulations will come into force on date of publication in the gazette.According to the new regulations, an application for an income tax compliance certificate shall be made to the commissioner general in respect of each transaction prescribed in the schedule.
The minister also indicated that a person requiring an income tax compliance certificate shall apply for it either in person or through their representative or agent.“That person may waive, expressly or by implication, any right which they may have to secrecy under the Income Tax Order of 1975, or its successor or any other matter relating to their affairs,” the minister said.
Certificate
On the validity of an income tax compliance certificate, the minister said the validity of each certificate shall be a maximum period of 12 months, corresponding to the year of assessment. It was also explained that new applications for an Income Tax Compliance Certificates shall be made, regardless of whether or not that tax compliance certificate issued initially had been utilised.
Revoked
The minister also announced that the Income Tax (Clearance Certificates) Regulations of 1988 were revoked.Under transactions requiring income tax compliance certificates and persons from whom income tax compliance certificates are required, it was stated that the person seeking renewal or transfer of any licence, permit or similar document relating to any trade, business, profession or vocation for business, that person will be required to produce a Tax Compliance Certificate.
All persons intending to transfer funds from Financial Institutions, Building Societies, Cooperatives in Eswatini to offshore banks and investments will be required to produce a tax compliance certificate.
