SWATCAWU’S STICKS VOWS HE’LL DEFY COURT ORDER

Africa-Press – Eswatini. SWATCAWU Secretary General (SG) Sticks Nkambule says the court cannot tell him how to conduct his defence.

He said, as a result, he will not make a physical court appearance today as ordered by the court. The SG of the Swaziland Transport Communication and Allied Workers Union (SWATCAWU) said this when responding to a question from this publication after an order was issued by the Industrial Court of Eswatini, calling upon him to physically appear in court today. The court order was issued by Industrial Court Judge Abande Dlamini last week during the case wherein the SWATCAWU SG is seeking an order setting aside a judgment that was granted in favour of government, as he believed that it was issued unlawfully.

Warrant

The said order was the basis on which government obtained a warrant of arrest against Nkambule. The court order in question is the one which sought to stop public transport workers’ strike action, which was slated for December 13 and 14, 2022. On Thursday, August 10, 2023, the unionist received a correspondence from his legal team from Howe Masuku Attorneys, where they confirmed that they attended court on the same day whereupon the matter was to proceed as directed by the court. The lawyers said on arrival in the court, they were approached by one Mr Manana from the Attorney General’s (AGs) chambers and advised them that the AG had insisted that he would like to have the transcript before the matter could proceed. Thereafter, the legal team of the unionist said they advised Manana that they were not prepared to postpone the matter for that purpose and the only postponement that they could grant them was if they agreed to a Rule Nisi being issued in terms of their court order.
