State Asks Court to Strike out Former Auditor General’S Reply

Africa-Press – Gambia. The State, through the Solicitor General and Legal Secretary, has filed an objection to former auditor general Modou Ceesay’s reply in a suit challenging his removal from office.

The Solicitor General argued that Ceesay’s reply is procedurally flawed, substantively deficient and that it introduced new issues not necessary for the determination of the suit.

The State’s objection is based on four main grounds, including that there is no provision in the Supreme Court rules for filing a reply to a defendant’s statement of case, and that the reply was not verified by an affidavit as required by law.

The Solicitor General also described Paragraph 19 of the reply as “unclear, irrelevant, and difficult to respond to,” and requested that it be struck out.

In response, Ceesay’s counsel Lamin J Darbo argued that the reply is a necessary response to the defendants’ version of events and that it does not introduce new matters.

“The amplifications triggered by the defendants’ statement are not new matters but answers to mere denials necessary to place the full facts before the court for a just determination of the case,” Ceesay’s counsel stated.

The Solicitor General further argued that Finance Minister Seedy Keita, who verified the reply, is competent to swear an affidavit given his central involvement in events preceding Ceesay’s removal from office.

The case is expected to continue with the court deliberating on the State’s objection and the plaintiff’s response.
