Supreme Court Joins Female Lawyers in Pro-Fgm Lawsuit

Africa-Press – Gambia. The Supreme Court of The Gambia presided over by Honorable Justice Edrisa Mbai Wednesday granted an application moved by The Gambia Female Lawyers Association [FLAG] to be joined as parties in Pro- Female Genital Mutilation [FGM] case against the State.

Appearing before a single-Judge of the Supreme Court, Lawyer Yassin Senghore with lawyer Neneh M.C. Cham, representing The Gambia Female Lawyers Association sought from the court to have their association joined into the FGM lawsuit.

Defense lawyer Lamin J. Darboe, representing the plaintiffs, did not object to the application sought by FLAG lawyers.

The presiding Judge then granted the application sought by FLAG lawyers and ordered the same to be done.

According to court records the FGM lawsuit was filed by Hon. Almamy Gibba , Foni alongside Yassin Fatty , Nano Jawla, Kadijatou Jallow, Concerned Citizen, Islamic Enlightenment Society , Women’s Association for Islamic Society Solidarity and Gambia Women Are Free to Choose Association against the State.

The plaintiffs are seeking an order from the court a declaration to strike out sections 32A and 32B of the Women’s Amendment Act NO. 11 of 2015 from the Women’s Act of 2010 so that only section 32 the original provision of the Women’s Act 2010 will be maintained.

The complainants also sought a declaration that the act of the National Assembly in passing the Women’s Amendment Act NO. 11 of 2025 was in excess of legislative authority, arguing that such was void and no effect, claiming that such at the time was inconsistent with sections 17(1) and (2), 25(1)(c), 28(1) and (2), 32 and 33(2) and (3) of 1997 Constitution.
