Africa-Press – Ghana. Ten years after being defiled and molested at Dansoman, the victim now sees the prospect of obtaining justice. The Office of the Attorney General has now recommended the prosecution of the two persons who allegedly committed the act.
The accused persons are: Abraham Botchway, a 40 year old Tailor and Samuel Kwame Acquah, a 28 year old driver. The Attorney General Office advice was received by the Police on February 17, 2022. The case docket was forwarded to the AG’s Office in the year 2017.
Accused persons appeared before a Circuit Court in Accra on Thursday and they have pleaded not guilty to the charge of defilement. The Court presided over by Mrs Christina Cann admitted Botchway and Acquah to bail in the sum of GHS80,000 with three sureties each, two of each sureties are to be justified with title deeds.
The Court adjourned the matter April 7, for Case Management Conference (CMC). Prosecution led by Deputy Superintendent of Police (DSP) Agnes Boafo said the complainant was Botchway’s wife. Acquah is a cousin of Botchway.
DSP Boafo said the victim turned 18 years on February 1, 2022 and she is the niece of the complainant. Prosecution said the complainant and the victim now lived at Assin Fosu and accused persons were previously residing at Dansoman Old Police Station.
According to prosecution, the marriage between the complainant and Botchway is almost on the verge of collapse. The prosecution said the complainant used to go to Assin Fosu to operate a hotel for her brother and Botchway was not enthused about that. Botchway began to complain and the complainant moved to Assin Fosu as they were having marital issues.
On December 14, 2017, prosecution said the complainant brought the victim to Dansoman Police Station and reported that in the year 2012, when the victim was staying with her and her husband together with Acquah, the two accused persons were having sex with the victim whiles they were residing at the Dansoman Old Police Station.
The prosecution said the victim was then eight years old. Prosecution said the complainant indicated that it was on December 11, 2017 that the victim told her that Botchway and Acquah had sex with her but she was afraid to tell her at that time. She therefore disclosed it to her biological mother who also informed the complainant.
“Based on this, a Police medical form was issued to the complainant to send the victim to government hospital for treatment,” and report back. DSP Boafo said the two accused persons were arrested and they denied the offence in their caution statement.
Prosecution said a duplicate docket was therefore forwarded to the Attorney General’s (AG’s) office for advice and on February 17, 2022, the accused persons were formally charged with defilement based on the fiat from AG’s office.
