Africa-Press – Kenya. EALA MP Kanini Kega has sent a message to former President Uhuru Kenyatta after the Political Parties Disputes Tribunal ratified Jubilee’s leadership.
The tribunal threw out an appeal against the ouster of Uhuru’s allies as party officials. Speaking on Monday after the tribunal’s decision, Kega said that Uhuru is free to join the party.
“To the former party leader(Uhuru), we want to confirm to you that you are still a friend and a member of Jubilee. When you really want to come back to the party our doors are open,” he said.
Kega dismissed the allegation that the party is up for sale. “The truth of the matter is that we have been mistreated in Azimio. We hope they will not appeal and accept the verdict of the Court. If they do, then we will be ready,” Kega said.
In a virtual ruling on Monday, the tribunal dismissed the appeal in its entirety and ordered the appellants to bear the costs of the suit for the respondents and interested parties.
“We answer the second issue as framed, in the negative. We have said so much to demonstrate that the order that commends itself to us is the dismissal of the appeal. The same lacks merit,” the tribunal said.
“Costs follow the event. A successful party should be awarded costs to cover the exigencies of the litigation. We do not see why we should depart from this principle. The appellants shall bear the costs of the Respondents and interested parties in this Appeal.”
Ousted party leaders Jeremiah Kioni (secretary general) David Murathe (chairman) and Kagwe Gichohi (national treasurer) had filed the appeal on May 25, seeking stay orders for the party leadership changes.
The Registrar of Political Parties had upheld the decision by the Jubilee National Executive Committee (NEC) meeting that suspended Murathe, Kioni and Gichohi from the Party.
