Governors call for withdrawal of Equalisation Fund Bill

Africa-Press – Kenya. The Council of Governors has demanded the withdrawal of the Equalization Fund Bill 2022, saying it is unconstitutional.

The bill is currently being considered for a second reading by the National Assembly.

“The CoG objects to the Bill in its entirety as it fails to conform to the High Court Judgment (issued in Constitutional Petition Number 272 of 2016 between CoG VS CS Treasury and others), the devolved structure of governance and the Equalisation Fund Regulations, 2021,” the governors said.

They urged the National Assembly to immediately withdraw the Bill to pave way for the implementation of the existing regulations or introduce a new bill that conforms to the Constitution and the orders issued by the court.

Last month MPs changed tack in their bid to push the Treasury to release billions to the Equalisation Fund for the development of marginalised counties.

A Senate committee had asked the Treasury to draft a standalone bill to provide a legal framework for the release of the funds.
