Africa-Press – Kenya. Former National Assembly Majority Leader Amos Kimunya was Tuesday freed on Sh700,000 cash bail by the Anti-corruption Court in Milimani.
He was released alongside two others, former director of land adjudication Lillian Njenga, and Junghae Wainaina, chairman of the board of Midlands Limited, arraigned for trial in the revived Sh60 million land fraud case.
Njenga and Wanaina were each granted a Sh1 million cash bail.
Chief Magistrate Lawrence Mugambi, in his ruling, rejected a plea by Kimunya to have the case handled by Magistrate Felix Kombo.
Mugambi said it would be unfair since his decision was overturned.
“Kombo made his decision in this case but the same was overturned by the High Court after finding it to be improper. My view is that this matter is tried before another court,” he said.
Kimunya will now have to defend himself over accusations of irregularly transferring 25 acres of land worth Sh60 million in Nyandarua to a private company when he was a minister in 2005.
The same applies to his co-accused persons who are facing various graft-related charges.
Last week, the High Court reversed Kimunya’s acquittal in the fraud case after DPP’s appeal.
Kimunya, Njenga, and Wainaina were acquitted by Magistrate Felix Kombo in June 2021. But the DPP, through Alexander Muteti, appealed the acquittal saying the court erred in law by setting them free.
After considering the evidence adduced, Justice Esther Maina on Thursday said she was satisfied that the prosecution established a valid case against them.
She said the three should not have been acquitted but placed on their defence.
