Africa-Press – Kenya. The prime suspect in the murder of businesswoman Monica Kimani, Jowie Irungu alias Jowie, has been ordered by the High Court to leave Nairobi.
Delivery the judgment on Monday, October 19, Justice Cecilia Githua ordered Jowie to obey bail terms that required him only to work and live within Nakuru.
“I hereby issue a warning against the respondent to abide by the orders issued by Justice Wakianga in respect to the area of domicile. He is required to work within the domicile area (Nakuru),” ruled the Judge.
The judgment comes after the Director of Public Prosecution (DPP) moved to the court stating that Jowie had violated the court’s ruling and continued to move and reside within the Lang’ata area.
The DPP told the court that Jowie had gone against an order that restricted him only to move and reside within Nakuru.
In the application, the DPP had told the court that the area where Jowie resided was a secondary crime scene and locality of potential witnesses.
“That the accused has not only gone against the honorable court’s finding on the location or place of abode when the honorable Judge granted the bail terms by being away from Nakuru County. He continues to move and reside within Lang’ata area being the secondary crime scene and the locality of the potential witnesses who have and are yet to testify,” read the application.
The DPP further claimed that Jowie was reported to Lang’ata police station by Rodgers Ochieng Okuta on March 7, who claimed that Jowie physically assaulted him in hotel 1824 at about 8:30pm when he was making merry at the club.
While responding to the application filed by the DPP, Jowie’s lawyer David Ayuo argued that Okuta withdrew the matter from the police station after a settlement with the accused.
Ayuo further defended the accused, saying that he was only looking for a means of survival since he had to provide for his child and aged parents.
On his part, Jowie claimed that he was too drunk to recall what transpired at the club. He stated that he could only fathom being helped to board a taxi home, after which he was taken to Lang’ata Hospital by his sibling only to find himself at Lang’ata Hospital nursing a deep cut.
There was a relief for Jowie as Justice Cecilia declined to grant a request by DPP to cancel his bail terms.
