COURT TO CONTINUE TO HEAR EVIDENCE

Africa-Press – Lesotho. The High Court through Justice Charles Hungwe will on Monday next week continue to hear evidence from the defence in a case in which four police officers are charged with the murder of their colleague Police Constable Mokalekale Khetheng.

When the case was adjourned earlier this month, one of the accused, Retired Superintendent Thabo Tsúkulu, had completed his evidence.

Tsukulu who was in 2016 an Officer Commanding Hlotse Police Station has in his evidence denied allegations that Khetheng was arrested and brought to him on the day he died. He stated that the deceased was brought to the police station, not under arrest, so he could talk to his superior who was complaining that he had been skipping work.

He testified that Khetheng could not be brought to his office because he had disappeared.

The defence had last month began to present its case after the prosecution closed its case. This was also after an application for discharge moved by the accused in terms of Section 175 (3) of Criminal Procedure and Evidence Act 1981 was dismissed by the court.

According to the section: ‘If at the close of the case for the prosecution, the court considered that there is no evidence that the accused committed the offence charged in the charge, or any other offence of which he might be convicted thereon, the court may return a verdict of not guilty’.
