Newly appointed Director of Public Prosecutions (DPP) Masauko Chamkakala has kept under wraps his response to Attorney General Thabo Chakaka Nyirenda’s advice to his office to allow the Anti-Corruption Bureau (ACB) to appoint Mordecai Msisha as part of the bureau’s prosecution team.

On November 28 2022, former DPP Steven Kayuni rejected the ACB’s application to appoint Msisha as public prosecutor on behalf of the graft-busting body in respect of specific corruption-related cases.

When asked Thursday, Chamkakala refused to divulge information on the matter. “I do not divulge internal operations information. Just be assured that we are working with the ACB on all cases requiring cooperation,” he said. ACB spokesperson Egrita Ndala also pushed the matter back to the DPP.

The bureau had sought consent on Msisha’s appointment in order to prosecute one of the cases in which United Kingdom-based businessperson Zuneth Sattar is alleged to have sought the assistance of a public officer to secure government contracts.

On January 11 this year, Chakaka Nyirenda wrote the then-DPP Kayuni, advising him to rescind his office’s earlier decision. “After careful consideration of your decision, I am of the view that you should revisit your decision of rejecting the appointment.

In the circumstances, I advise that you appoint Mr Mordecai Msisha as public prosecutor to prosecute the specific case(s) on behalf of the Anti-Corruption Bureau,” Chakaka Nyirenda’s letter reads.

In the letter Chakaka Nyirenda further said as a condition of the appointment, and as is the case with any other lawyer appointed as a public prosecutor, Msisha would be required to be submitting to the DPP’s office and ACB progress reports on all matters he will prosecute.
