Africa-Press – Malawi. Former presidential aide Norman Chisale has applied to the Supreme Court of Appeal, asking it to unfreeze one of his bank accounts. Court documents in our possession indicate that Chisale wants the Supreme Court of Appeal to grant him access to his First Capital Bank account.
He indicates that he wants to access the funds to settle accrued legal costs. In his sworn affidavit, Chisale says he needs K50 million to settle outstanding legal costs to his retained lawyers.
Chisale further indicates that he wants the money to pay school fees for his three children who are at an academy, a secondary school and technical college.
“It is my humble prayer that the court should consider varying [terms of] the preservation order so that I am granted access to the account maintained at First Capital Bank by varying the preservation order so that I can pay the legal costs accrued and payable to legal counsel who have always represented [me] in the matter and the constitutional matter,” the appeal document needs.
Meanwhile, offices of the Attorney General and Director of Public Prosecutions have objected to the plea. On December 21 2022, the Supreme Court of Appeal dismissed Chisale’s application for stay of High Court order proceedings on forfeiture of his property.
Chisale recently applied to the Supreme Court of Appeal, asking it to stay civil proceedings regarding the forfeiture of his property and refer constitutional issues arising out of the matter to the Chief Justice for certification.
The Supreme of Court of Appeal has set January 18 as the day it will make its determination on the matter. The case will be heard before Justice Charles Mkandawire in Blantyre.
