According to news on Zodiak, social media influencer, Pemphero Mphande, has dragged Telekom Networks Malawi (TNM) and TNM Mpamba Limited to court over alleged negligence, breach of statutory duty. I think this a good case for Mphande against the company so that, first, Mphande’s name is cleared from the dirty game.
Second, the truth of the matter must be declared in court as to who is responsible in damaging the name of an innocent victim, then pay for the damages accordingly and learn to be careful in future.
As for defamation Mphande is making , I am of the view that he would be dragging the wrong defendant to court, if he took TNM. Mphande should consider suing the people who are using his name on social media for defamation. As for TNM, the company should answer charges for negligence and beach of extraordinary duty.
Lawyer for Mphande, Geofrey Taumbe of Clarkes Attorneys, should consider taking the right charges to court for damages against the people who have registered their phone numbers on the network under the name, ‘Pemphero Mphande’ and demanding money from people for defamation while TNM should be taken to task for negligence and beach of statutory duty respectively.
The summons are a warning shot to all network providers to be extra careful in the way registration of phone numbers is being handled to avoid future repercussions.
