CSMMP Expels and dismisses judicial officers for unlawful practices

Africa-Press – Mozambique. The Superior Council of the Public Prosecution Service (CSMMP) announced yesterday (15) the dismissal and expulsion of a group of eight Judicial Officers and Assistant Judicial Officers from the provincial prosecutor’s offices of Nampula, Manica, Zambézia, and Sofala.

This includes the expulsion of three judicial officers and assistant judicial officers, with the categories of District Court Clerk and District Judicial Clerk, from the staff of the provincial prosecutor’s offices of Nampula and Manica.

The CSMMP explained in a statement that the expulsion was due to the misuse of their functions for personal gain and to the detriment of others, by soliciting and receiving monetary amounts to facilitate the release of a detained defendant and the shelving of a preliminary investigation.

The note stated that the decision was made during the XXI Ordinary Plenary Session held on the 3rd and 5th of April, which also decided to dismiss five (5) officers with the categories of Assistant District Court Clerk and District Judicial Clerks from the staff of the provincial prosecutor’s offices of Zambézia, Manica, Sofala, and the provincial Anti-Corruption Office of Maputo.

The dismissal of the five officers was due to the misuse of their functions for personal gain and to the detriment of others, by receiving and misappropriating monetary amounts, with the purpose of not forwarding accused cases to court for trial and by withholding counterfeit notes seized and attached to a preliminary investigation.

“The aforementioned sanctions result from the violation of professional duties and principles, namely diligence, legality, dignity, loyalty, and honesty,” the document reads.

The CSMMP also stated that, given the evidence of criminal offenses, copies were extracted and forwarded to the Public Prosecution Service for the initiation of relevant criminal proceedings.

It guarantees that it will continue to carry out actions aimed at raising the ethics and integrity of its employees in order to improve the performance of their duties and hold offenders accountable.
