Africa-Press – Namibia. Windhoek High Court Judge Thomas Masuku on Monday in a decisive summary judgement ruled in the favour of the Development Bank of Namibia (DBN) to be repaid over N$14 million owed by Ombili Health Centre.

The Centre is owned by Peter and Malakia Elindi.

The matter stemmed from the entity’s failure to repay a loan signed on its behalf by Peter Elindi in 2017, who was its director at the time.

After countless unsuccessful attempts by the bank to recover the outstanding amount, DBN sought an order to compel Ombili and its sureties, the Elindi’s and Nyambali Medical Centre to pay 14.1 million to the bank.

Since, Peter, Malakia and Nyambali were jointly and severally liable for the indebtedness of Ombili, they must ensure the amount is repaid back in full to the bank.

In terms of the loan agreement, DBN agreed to lend Ombili an amount of N$2.6 million, which the entity would repay the amount within 36 months in monthly instalments.

Another component of the agreement, which comprised of a property loan agreement, an advance of N$10.7 million was given to Ombili, specified to be repaid back within 132 months.

The amount accumulated to over N$17 million after Ombili failed to pay the monthly installments in terms of the facility agreement, and since an amount was written off via a settlement agreement, the entity had to pay back N$12.2 million before 31 August 2024.

However, Ombili breached the agreement by failing to pay the money before 31 August last year, and the debt accumulated to N$14.1 million as of 11 July 2025.

“Summary judgment is granted in favour of the applicant and against the first, second, third and fourth respondents, jointly and severally, the one paying the other to be absolved as follows; payment in the amount of N$14 145 993.53,” ruled Masuku.

The matter was regarded as finalised and removed from the roll.
