Africa-Press – Namibia. The dismissal of former Namibia Students Financial Assistance Fund (NSFAF) chief executive officer Hilya Nghiwete in February 2020 was unfair and without a valid reason, a High Court judge has ruled.

The dismissal of former Namibia Students Financial Assistance Fund (NSFAF) chief executive officer Hilya Nghiwete in February 2020 was unfair and without a valid reason, a High Court judge has ruled.

The fund must now pay Nghiwete the monthly salary she would have received from the time of her dismissal until mid-July 2021, judge Herman Oosthuizen also ordered on Friday.

The order was given in a judgement on an appeal by the fund against a ruling of a labour arbitrator who in July last year found that Nghiwete had been dismissed unfairly. The arbitrator ordered that Nghiwete should be reinstated in her former position as chief executive of the fund.

Oosthuizen upheld the fund’s appeal against the arbitrator’s order for Nghiwete’s reinstatement, after noting that it was clear the employment relationship between the fund and Nghiwete had broken down and had been non-existent since she was suspended as chief executive officer in April 2018.
