The separation of powers « remains an intangible principle of our Republic », replied the spokesman of the Senegalese government, Abdou Karim Fofana, to the authors of the petition asking the President of the Republic, Macky Sall, to release Ousmane Sonko and other opposition activists.
One hundred and forty-one Senegalese and foreign personalities from various sectors of activity demanded from the Head of State “the automatic release of the opponent Ousmane Sonko” and “of the other people detained for […] their opinions’.
They also asked him to withdraw the decree dissolving Pastef-Les patriotes, Mr. Sonko’s party.
Former Senegalese Minister of Justice Serigne Diop, Professor Alioune Sall, former international judge, Mamadou Ismaïla Konaté, lawyer and former Minister of Justice of Mali, Reed Brody, lawyer at the bar of New York (United States of America ), his Senegalese colleague Abdoulaye Tine, the Burkinabè Bénéwendé Stanislas Sankara, lawyer and former minister, the former prosecutor Alioune Ndao and the former Prime Minister of Senegal Aminata Touré signed the petition.
L’ancien ministre gambien Demba Ali Jawo, le député ivoirien Michel Gbagbo, Mamadou Lamine Diallo, député et vice-président de l’Assemblée nationale du Sénégal, les journalistes Ibrahima Lissa Faye et Mame Gor Ngom, et le professeur Boubacar Diop, dit Buuba, font partie des auteurs de la tribune.
Les pétitionnaires ‘’doivent […] se réjouir que la séparation des pouvoirs […] reste un principe intangible de notre République’’, a répondu le ministre du Commerce et porte-parole du gouvernement sénégalais.
‘’Une centaine d’hommes et de femmes […] du Sénégal et d’ailleurs ont signé une pétition relative […] à la démocratie et à l’État de droit. Ces sujets leur ont […] servi de prétexte pour appeler à la libération d’un homme politique, au mépris des principes de ce même État de droit’’, a écrit Abdou Karim Fofana.
Ils s’inscrivent par ‘’leur démarche’’, a reconnu M. Fofana, ‘’dans la longue tradition du débat d’idées consubstantiel à notre démocratie’’. ‘’En revanche, a-t-il soutenu, voir des intellectuels et professionnels du droit, pour la majorité des signataires, fouler aux pieds le principe de la séparation des pouvoirs nous interpelle.’’
« A lack of knowledge of the functioning of justice »
« Calling on the President of the Republic to ask the public prosecutor’s office, through the Keeper of the Seals, to release a detainee charged by an examining magistrate is […] a misunderstanding of the functioning of Senegalese justice » or « an attempt to maintain an amalgam », argued the government spokesman.
Ousmane Sonko a été arrêté le 28 juillet. Trois jours plus tard, il a été inculpé d’appel à l’insurrection, d’association de malfaiteurs, d’atteinte à la sûreté de l’État, de complot contre l’autorité de l’État.

M. Sonko est classé troisième à l’élection présidentielle de 2019, derrière l’ancien Premier ministre Idrissa Seck et Macky Sall, qui s’est fait réélire. Pastef-Les patriotes et ses alliés constituent l’un des principaux groupes parlementaires de la législature élue le 31 juillet 2022.
