
Africa-Press – Seychelles. The Ministry of Transport announced yesterday that cabinet has given first approval for the drafting of the Merchant Shipping (Marine Accident Reporting and Safety Investigation) Regulations, 2022.
Maritime Accident Investigation Board (MAIB) is established under Section 227 of the Merchant Shipping Act, as the entity responsible for making safety investigations for any incidents and accidents that occur in our maritime space.
This new regulation will be transposing international obligations under the Code of International Standards and Recommended Practices for a Safety Investigation into Marine Casualty or Marine Incident in our national legislation.
Noting part of the introduction of the Code: “Acknowledging that the investigations and proper analysis of marine casualties and incidents as to lead to greater awareness of casualty causation and result in remedial measures, including better training for the purpose of enhancing safety of life at sea and protection of the marine environment”.
This new regulation will make some of the following provisions:
• Board function
• Duty to report accidents and serious injuries
• Assessments
• Procedures of conduct of investigations
• Collection of evidence and preservation of evidence
• Disclosure of records
• International cooperation
• Marine safety investigation reports
• Publication of final reports
• Recommendations
The Ministry of Transport strongly supports having this regulation approved as it will assist in sensitising the public about the MAIB and its functions, as well as its procedures of investigations. This is also with the intention of equipping MAIB with more resources and capabilities to discharge its functions.
