Africa-Press – Zambia. BALIFFS in Luanshya have seized embattled former National Democratic Congress leader Chishimba Kambwili’s car following his failure to pay Bridget Atanga about K96,000.
According to Atanga’s lawyer Ignatius Tindi, the seizure was reinforced following the Ndola High Court’s judgment in which it awarded K96, 861.19 in costs to the plaintiff.
“[The car] was seized by the bailiffs because he needed to pay money to Bridget Atanga which the court awarded,” Tindi said. He said that at the last court hearing on 23rd April the court
awarded costs to the plaintiff who sued on behalf of the Josephs Akafumba NDC. Atanga sued Kambwili on behalf of NDC for, among others, “masquerading” as president of the political party.
“On that particular day, April 23rd, because of something they didn’t
right (Dismissal for Appeal for incompetence) they were condemned to costs. We were told to agree on what was to be paid but we failed to agree so we went back to court and had the cost taxed. An amount of K96,000 was awarded after taxation. So when you get that certificate of taxation, that is equivalent to the judgment of the court and can be reinforced through any means of reinforcing money judgment,” Tindi said.
Tindi said after Kambwili and his agents failed to pay the money, he applied a fifa which was issued from the Ndola High Court. “Now the bailiffs have seized his vehicle based on that. It’s a Chrysler, black in colour. Kambwili at the time was masquerading as NDC president so Bridget Atanga was asking the court that herself and other named individuals were the registered office bearers, duly registered office bearers of the party and Kambwili was not among them,” said Tindi.
