Africa-Press – Zambia. The Governance, Elections, Advocacy Research Services-GEARS initiative has asked the Constitutional court to help settle the debate on whether withdrawal of a duly nominated candidate is the same as resignation and whether that triggers a cancellation of the nomination and invitation of fresh election.
GEARS Initiative Executive Director Mcdonald Chipenzi say in addition, the organization wants to find out whether or not a withdrawal/resignations occasioned by a duly nominated candidate two days to the election date can trigger a cancellation of duly conducted nomination process and an invitation of fresh election outside the within 30 days prescribed by law.
Mr Chipenzi says the whole move is driven by and done in public interest and it will be good that the courts interpret the constitution especially that various stakeholders have recently accused the Electoral Commission of Zambia-ECZ of interpreting the constitution outside the courts when it applies the law as it is written in the constitution.
He is hopeful that the court will help in guiding the nation over this matter for the sake of law development in Zambia. An independent candidate in the forthcoming Kabushi Parliamentary by-election Alfred Yombwe has withdrawn his nomination 2 days before the election citing uneven playing field.
