Africa-Press – Zimbabwe. THE Zimbabwe Human Rights Commission (ZHRC) has condemned the justice system for treating circumstances involving locals and foreigners differently, raising concern over discrepancies in the outcomes of some court cases.

There was a public outcry around the treatment of two cases involving drug offences, with ZHRC saying the cases raised critical questions about equality and non-discrimination within our justice delivery system.

Wadzanai Siyamachira (38) was arrested on January 23 this year following police surveillance that led to the discovery of three grammes of cocaine at her Harare residence.

The cocaine was valued at US$340 and Siyamachira was sentenced to 18 months in prison, with six months suspended, resulting in an effective one year behind bars for unlawful possession of dangerous drugs.

In contrast, 10 Chinese nationals, who were arrested on September 3 this year during a police raid and were found with cocaine, methamphetamine and other substances valued at over US$1 000, were granted bail after only one night in custody and fined a US$150 each, with the option of six months imprisonment.

“The contrasting outcomes in these cases highlight a troubling double standard. While Ms Siyamachira faces a stiffer sentence for a relatively small quantity of drugs, the Chinese nationals received lenient treatment, raising questions about the fairness and impartiality of our legal system,” ZHRC said.

“The differential treatment between these two cases not only undermines the principle of equality before the law, but also erodes public trust in the justice system.

“Citizens are increasingly concerned that the justice system may favour foreigners, leading to perceptions of injustice and inequality.

“Such sentiments, amplified through social media, can foster a climate of mistrust and cynicism towards legal institutions.”

The commission called on authorities to investigate the causes of such disparities in order to restore faith in the justice delivery processes.

“The ZHRC calls for an immediate review of the treatment of drug-related offences, ensuring that all individuals, regardless of nationality, are held to the same legal standards.

“The ZHRC urges the government and relevant authorities to undertake reforms that guard against corruption, promote transparency, equality and fairness within the justice system.

“A commitment to equitable treatment for all individuals is essential in fostering a just society where citizens feel empowered to seek justice without fear of discrimination.”

ZHRC is the national human rights institution with a constitutional mandate to protect, promote and enforce human rights for Zimbabweans.

It is also the public protector or ombudsman for Zimbabwe with a mandate to protect the public against maladministration and abuse of power by the State and public institutions and their officials.
