Buyanga’s Ex Appeals Against High Court Ruling on Guardianship Of Minors

AFRICA Medallion Group (AMG) founder, Frank Buyanga’s ex-girlfriend Chantelle Muteswa has made a Supreme Court appeal against a High Court ruling that awarded the two joint custody of their minor son.

Justice Happias Zhou last week made the ruling in favour of Buyanga who wanted to be granted custody to his son.

The two are entangled in a bitter fight over the five year old child, a saga which has also sucked in the First Family and changes in common law regarding guardianship.

In his ruling, Zhou, declared the common law which treats the mother of a child born out of wedlock as the sole guardian, invalid before he called on the legislature to repeal it.

However, Muteswa Friday appealed against the ruling at the Supreme Court, arguing that Zhou had erred in his judgement and is seeking redress.

“The court a quo grossly misdirected itself in enquiring into and determining the constitutionality of the common law position on custody and guardianship, which position was irrelevant in the determination of the dispute before it,” said Muteswa in her Supreme Court appeal.

Muteswa’s appeal is yet to be heard.
