Khupe Moves To Block Bhebhe From A Court Case

Thokozani Khupe has moved to block Abedico Bhebhe who is the court resurrected party’s organizing secretary from responding to the lawsuit filed against their camp by 2 party members, The Standard reports.

2 party members Gilbert Kagodora and Nason Mamuse approached the High Court in a bid to get Khupe to release key information about the court-sanctioned congress. Bhebhe who was the fourth respondent on the application filed an answering affidavit and threw his allies under the bus and said they were trying to influence the outcome of the congress.

In the answering affidavit targeting Bhebhe filed by the interim MDC T leader, Khupe said:

The fourth respondent ought not to have been joined to these proceedings. He is not permitted by the constitution of the first respondent (MDC-T) to speak about the first respondent’s affairs in a court of law in respect of any functions assigned to him under the constitution.

He is accountable to me and the relevant organs of the party. If any issues arise from his official duties, he cannot be sued in a court of law. It is the party and its authorised officials who may sue or be sued on behalf of the party. He must be removed from these proceedings.

I am advised that the fourth respondent’s papers do not comply with the law on notices of opposition. He is not opposing the basis of the application; he is adding his own grievances and has his own prayer. This is not permitted by our law. His papers must be expunged from the record.

The court application which now has Khupe and Bhebhe on 2 different sides of the same camp was initiated by the MDC T members after MDC T Secretary General Douglas Mwonzora said recalled party members were not allowed to contest in the upcoming by-elections.
