Africa-PressZimbabwe. Human Rights NGO Forum director, Musa Kika, Tuesday withdrew an application for leave to execute a pending appeal in the matter of Chief Justice, Luke Malaba.

Three High Court judges, Justices Pisirayi Kwenda, Esther Muremba and Siyabona Paul Musithu recorded the withdrawal and made a court order to the effect.

Kika wanted Malaba barred from returning to the office pending a ruling on a government appeal against a High Court ruling that nullified the extension of Malaba’s term of office beyond retirement age.

Kika did not give reasons for the withdrawal. Costs were awarded to Judicial Service Commission and the government. Kika’s legal team confirmed the development saying:

_We withdrew before the respondents filed any papers._

_So this is ridiculous._

According to updates by Zimlive, the court adjourned to consider if the hearing should proceed after Kika withdrew the application.
