Magistrate Blocks Marry Mubaiwa’s Bid To Move Attempted Murder Trial To SA

Africa-Press – Zimbabwe. Harare magistrate Feresi Chakanyuka has rejected a bid by Marry Mubaiwa to have her trial moved to South Africa where she allegedly attempted to murder her ex-husband and Vice President Constantino Chiwenga.

Marry had challenged Zimbabwean courts’ jurisdiction to try her over an offence that allegedly took place in a South African hospital.

However, in her ruling, Chakanyuka said that there was no need to transfer the trial to South Africa as both parties in the matter are based in Zimbabwe. Said Chakanyuka:

The parties involved are both Zimbabweans, hence the country has the right to deal with the matter as there will be no breach of international law.

There is no danger of offending the South African authorities since there was no danger to them involving this crime.

The magistrate also noted that there was no evidence South African authorities had taken interest and were investigating the matter.

Chakanyuka then set the trial for 29 September this year.
