Africa-Press – Angola. Prosecutors and judges from the Comarca of Cabinda, as well as investigators from the Criminal Investigation Services (SIC) and the Directorate for the Investigation of Criminal Illicits (DIIP), assigned to the National Police, learned yesterday about the role of “guarantee judge” ” – a new figure inserted in the 2020 Code of Criminal Procedure

Justice operators had the opportunity to find out about the figure of the guarantee judge in a clarification meeting, led by the Deputy Attorney General of the Republic and Coordinator of the North Region, Cabinda, Bengo, Luanda and Belas, João Luís de Freitas Coelho, during a visit by three to Cabinda province, which ended this Thursday.

On the occasion, the judicial magistrate, Mateus Gonga, referred that the guarantee judge is a judicial figure distinct from the prosecutor, who will work in close relationship with the Public Ministry to monitor the rights and guarantees of citizens in conflict with the law and to boost preparatory instruction and reduce the excesses of pre-trial detention.

For the magistrate, João Luís de Freitas Coelho, the different bodies of the Ministry of the Interior (MININT) and the Public Ministry should discuss the role of the guarantee judge several times, in order to be more informed and overcome any doubts that may exist.

“The guarantee judge is a function exercised in the police investigation or investigative phase of criminal proceedings, by a judge of law, in charge of acting as guarantor of the effectiveness of the system of fundamental rights and guarantees of the accused in criminal proceedings and, especially, of disposing of about the provisional arrest of an investigated person and their respective requests for provisional release”, he explained.

He also pointed out that he is also responsible for analyzing requests for precautionary measures made during the investigation, in addition to providing for requests for the extension of compulsory psychiatric hospitalization, as adopted in countries such as France, Italy, Panama and Brazil.

In Cabinda, João Luís de Freitas Coelho, held meetings with the MININT delegate and Police Commander, Commissioner, Francisco Noticia Baptista, with whom he analyzed questions about judgments and punishments in cases of fuel smuggling.

He also traveled to the municipality of Buco-Zau, where he found out about the functional state of the magistrates and the sector’s structures, as well as X-rayed, in the city of Cabinda, the new SIC building where he took the opportunity to inspect, registered processes and covered by the Amnesty Law.

He also held a brief meeting with the governor of Cabinda, Mara Quiosa, with whom he spoke, among other matters, about the current socio-economic, political, military and judicial reality in the province.
